Let's not forget the African American Leadership of Greensboro and Guilford County that may have prevented: Thomasville apartment fire under investigation

"The fire department is investigating an afternoon apartment fire at 300 C James Ave.

Crews were called to the apartments around 2:30 p.m., Sunday, and left by 5:15 p.m.

There were no injuries, according to police and fire reports."

When will the African American political leadership
of Greensboro and Guilford County
acknowledge they betrayed their own people
for letting Robbie and friends at TREBIC kill RUCO?

What will the new City of Greensboro manager suggest?

Will that she was the lobbyist for the Greensboro Parnership,

Guilford County Chairman Skip Alston is Muddying up the Redistricting Process for a Losing Proposition

Guilford County Chairman Skip Alston is trying to muddy up the waters with the talk of referendum and also having a 9 member map turned into the Department of Justice(DOJ) along with the 8 member map at the same time.

In the High Point Enterprise on July 26, 2011 this is what was said:


"County Attorney Mark Payne reminded the committee that commissioners can work on 2 tracks. "If there are two plans we should send them at the same time". "
 Here is the problem. When the state made the law to make Guilford County a 9 member board with 8 districts and 1 at large and that they needed a clearence from DOJ in this bill there was no mention of sending any other plans for them to consider. During the Guilford County Redistricting Committee meetings we have been hearing that Skip Alston wants to also send a 9 member map with 2 at large to the DOJ if the citizens of Guilford County will approve a referendum to by pass what was done and to go back to a 11 member board .

I think this talk of a referendum will come up during the August 4th meeting to have them put the referendum on the November election. There is one huge problem in that the City of High Point has their elections in even years and if Skip Alston wants to put this losing proposition on the ballot in November you will probably see plenty of citizens in High Point and also the unincorporated Guilford County not like this one bit going to the polls to vote on one item. I am sure the DOJ will not like this referendum and a City with over 100,000 will only be going to the polls to vote on this one item. What is the cost for doing this?

If we are talking about referendum then let's talk a 7 board member for Guilford County put that on the ballot as well.

From the quote above it seems like they want to completely mess with the process to also add these other maps to the mix where no one has seen or even talked about a 9  plus 2 member map.County Attorney wants to send them both at the same time but to me it needs to be a complete separate avenues for the DOJ and if they do send them together then you will see some objections from me and plenty of other people in this county.

Guilford County Chairman Skip Alston's Jig Saw Gerrymandered Redistricting Map That Should Be Dead on Arrival

Above in Exhibit A is the "mystery map" that was turned in to the Guilford County Legal Department from the Chairman of the Guilford County Board of Commissioners Skip Alston.

A 7-9-2011 Greensboro News and Record above the fold headline story titled "Maps Drawn on Party Lines" CLICKHERE . An interesting excerpt:

"Alston said two of the maps he submitted were put together by county staff under his direction. The third, he said, he put together with a group of “political advisers” he declined to name.

“They’re not big players, just some people who know the area and the issues whose opinions I trust,” Alston said. “They’re just an informal advisory committee.”

These mystery people know the area and if you want to see what a GERRYMANDERED JIG SAW REDISTRICTING MAP THAT SHOULD BE DEAD ON ARRIVAL looks like,
take a look at Exhibit A.

Exhibit B is what Alston's map looks like when you add the precincts to the map.

Check out the 6 red circled areas on Exhibit B. This is what a blatantly gerrymandered map looks like where they have to wrap around, barely sliver through to get the desired results.

Looking at the numbered districts in Exhibit A, let's start out by talking about district # 5 where we have the most ridiculous gerrymandered aspect of the whole map.  This district stretches from the most eastern part of Guilford County in the town of Whitsett all the way south and barely underneath High Point precinct 23 to split the City of High Point in half and gerrymander all the way up Eastchester Drive to the intersection of Wendover Avenue. The map in exhibit B shows the 2 red circles where the small sliver of this map draws these citizens into District 5.  They split the Town of Pleasant Garden in half, which if you want to keep communities in a whole district to not disenfranchise, then why split the city in half?

Also in the Skip Alston and his mystery people map is District #2, which stretches all the way up to the Town of Oak Ridge, but as you can see from the map the Town of Oak Ridge is split in half between OR 1 and OR 2 , so now we have 2 smaller municipalities split between commissioners which should be done as little as possible or not done at all. NOTE ( My map that i submitted to the Guilford County Commissioners CLICKHERE is compact and only splits up Jamestown because of the Voting Rights Act to bring the High Point precincts over to have some of the Greensboro majority-minority areas to make them compact and feasible). On my maps Jamestown is split 3 ways which put one Jamestown area with the Adams Farm area while the Jam 5 is put in the southern and southeast district area.

Back to the map  of Chairman Alston's district #2 where we have now a district that should be mainly High Point but goes right to pick up precincts in Greensboro which makes absolutely no sense whatsoever.  So now we could have a situation in High Point where feasibly not one representative could be from the city because #5, #1, and #2 all take in other areas of Guilford County. Wouldn't that be nice to have a City in the top ten in population for North Carolina not have any representative from it's city in county government?

Let's take a closer look at Exhibit A to show you the absurdity of this map. District #5 wraps around #1 to sliver up to split with #2. Then #8 darts north through Greensboro to wrap around #7 and then back up off of battleground to #4 . #3 with just a little area that starts in Greensboro off of Jefferson road that then squeezes down on battleground avenue to a very small area, only to jump into the Stokesdale and Summerfield area of the county and splits Oak Ridge N.C. in half.  Then we have #2 which starts on western side of Guilford County up towards Oak Ridge with the split of Oak Ridge with #2, then east into Greensboro, which makes not one bit of sense.
As you can see from the so called "mystery map" from Skip Alston, with the help from political advisers who want to keep the same non-competitive gerrymandered maps for the next 10 years , this map should be dead on arrival. So in Chairman Alston's own words this map should be "DOA to the DOJ."

It is time for all citizens to speak up about this issue. After seeing this map turned in from the chairman, it is time to fight back for having sensible compact districts in Guilford County, not the absurd complete gerrymandered crap that Skip Alston has thrust upon us.

Tom Terrell on the Solar Farm Deal: Are Skip Alston and Dan Lynch getting rolled by out of town carpetbaggers on the Solar Farm?

“If the atmosphere (in the meeting) is any indication,
I think we would be the front-runner,” said Melvin “Skip” Alston,
the chairman of the County Board of Commissioners.

“I think they were very impressed. ... I was very impressed with them.”


...A new company in Melbourne, Florida called National Solar Power
has just listed Guilford County as one of seven locations throughout the Southeast
where it might locate a mega solar farm at least 4,000 acres in size
(either as one tract or several tracts).

It would be the largest solar farm in the world.

...Triad Business Journal ...noted

1) this county doesn’t have 4,000 contiguous acres
or even 20 tracts of 200 contiguous acres

2) the company says tax credits and incentives are key
BUT nobody at state or local levels had even heard of the company or the project

3) it won’t create but a handful of long-term jobs, yet tie up 4,000 acres,

4) the only possible buyer of the electricity – Duke Power – knew nothing about it,

and 5) they went to the media first,
indicating either a total lack of sophistication and experience
or that something else was going on...

“We will do everything in our power to successfully land this project,”
said Dan Lynch, president of the Greensboro Economic Development Alliance.

“We had a roomful of Greensboro and Guilford County leadership,
and I think that message was strongly conveyed.”

Solar farm deal looks bright

A more subtle – but to me a far more interesting – comment was made
in a July 2, Greensboro News & Record editorial
where the paper questioned whether this “industrial” use would gobble up land
that should be reserved for industries that would hire more people,
saying “Solar farms might be better situated in a different place than land
that a manufacturing plant might need – near a highway or the airport, for example.”

“Dan Lynch did a good job of pulling the major players together,” Alston said.
“I think that is what impressed them.”

National Solar Power had three people at the meeting.

Company officials said they would be willing to consider a regional approach
for pulling together the 4,000 acres they say they need for the project.

“They would welcome that,” Lynch said. “It doesn’t have to come from one area.”

...Why would a solar farm – inherently an industrial use
– be relegated to the areas and zoning districts reserved for industry?

In fact, they should not.

Solar farms require wide open spaces, and they generate practically no traffic, noise,
dust and any of the other qualities we link to industry.

They could be located off country roads with little access to highways and airports.

...I accept the company’s statement
that incentives and tax credits will play a major role in its decision.

It’s the only point they made that makes any sense to me.

...companies occasionally establish a “straw man” location
to create the appearance of competition
so that representatives in their desired location will sweeten the incentive package.

Company officials provided more details about the project Thursday
but did not make a specific request for incentives.

“They said it would be much easier to do the deal here than in Florida,” Lynch said.

“North Carolina has a very favorable tax climate for landing solar farms.”

National Solar Power officials left with some possible sites to consider.

Lynch expects to follow up with company representatives by phone next week.

“We have to look at this like a business transaction,” Lynch said.
“In addition to making sense for the company, it has to make sense for the community.

It has to be a solid fit.”

Alston thinks that’s the case.

“I think it will be up to Dan Lynch and the economic development folks
to go ahead and seal the deal.”

Solar farm deal looks bright

My experience suggests that National Solar Power has chosen not one
but at least two and possibly a distant third location.

While it is considering engineering and other feasibility matters
it is negotiating aggressively with those local and state officials,
the local power companies, landowners and building contractors.

And in each discussion they can tell a county or a landowner
that they are considering seven – 7 – locations,
so they should not be stingy with incentives or greedy on land price.

What sites were shown to the company by Dan Lynch?

In that respect, Guilford County was just somebody’s poor choice to add to the faux list,
and now the company looks like what it truly is,
a neophyte in the area of development and local government incentives.

We are being used as a pawn on this solar pipe dream.

When you have a Florida company with 3 places in florida they want to place the solar farm
and when we find out not one in NC development community knew about this
then we need to understand that someone told their reps
you need to have places outside of Florida to make the competition for tax dollars viable,
it would be interesting to find out why they picked guilford county.

Are we getting a reputation for giving away the farm in regards to taxpayers money in incentives ?

Reducing Guilford County Commissioners to 9 is Making It's Way Through The NC General Assembly

There has been talk over the years to reduce the size of the Guilford County Commissioners . Now we have Rep. John Blust who has introduced House Bill #467 CLICKHERE  and also a map of new districts CLICKHERE both of these links are from Mark Binker from the Greensboro News and Record.

Just last night the North Carolina House of Representatives passed on the third reading 66-48 Rep. Blust's bill and now it works it's way to the Senate side of the aisle. It will be interesting to see who will read this bill to the North Carolina Senators because the Democratic delegation in Guilford County will probably not offer up this bill in Sen. Robinson or Sen. Vaughan. We will see either Sen. Bingham or possibly majority leader Sen. Berger talk about this bill to the North Carolina Senators.

The adding of the Guilford County Commissioners to being 11 members should have never happened in the first place 20 years ago. But let's take a closer look at the make up of our 100 counties all over this state. First point to make is that Guilford County is the only county and i repeat it is the only county out of 100 who has 11 commissioners.

This bill would reduce the size by 2 members saving the taxpayers of Guilford County $41,400 plus their travel allowance they get. Reducing the Guilford County Commissioners to 9 will make them be in a select group of only 3 other counties out of 100 in the State of North Carolina in Bladen, Pitt and Mecklenburg Counties. So if this bill passes we will be in line with 4% of the counties in North Carolina.

Here is the percentages of the sizes of county boards all over this state.

1% with 11 commissioners which is Guilford County
3% with 9 commissioners with Mecklenburg being a 9 member commission
1% with 8 commissioners
29% with 7 commissioners with Wake and Forsyth County being a 7 member commission
3% with 6 commissioners
61% with 5 commissioners
2% with 3 commissioners

This is a no brainer to pass this bill just looking at the make up of all the counties all over this state. What makes Guilford County so special that they need 11 commissioners? NOTHING.

Just this past month we had the chairman of the Guilford County Commissioners Skip Alston who could care less what the Conservatives 4 Guilford County had to say and Doug Clark from the Greensboro News and Record had this post titled "Alston Shows Why County Redistricting Is Needed" CLICKHERE

In yesterday's article CLICKHERE  we have Chairman Skip Alston say this about this bill


“But it won’t pass the Department of Justice. They’re going to recognize this as a retrogressive move that will dilute the voting strength of minorities,” said Melvin “Skip” Alston, the Democratic chairman of the Guilford Board of Commissioners"



The new talking point you will hear plenty in the next few months with redistricting on the state level comes into play is RETROGRESSIVE which is

1. to go back to an earlier, esp worse, condition; degenerate or deteriorate
2. to move backwards; recede

To hear the chairman state that he knows that what the U.S. Department of Justice is going to do is total hearsay and he has no proof of this. It will be interesting to see if it will pass the DOJ for approval but noting that no other county in the state has 11 board members throws that argument right out the door. Good luck with the retrogressive argument. Simkins PAC is in Bed with Action Greensboro Illegally

The George C Simkins Jr. Memorial Political Action Committee 3rd Quarter reports reveals a relationship that behind the scenes has been talked about but now is there for all to see .

The treasurer for the Simkins PAC is non other than Melvin "Skip" Alston Guilford County Commissioner as reported in TRIADWATCH, Mr. Alston needs to understand North Carolina Laws and how they work in regards to campaign contributions.

If you can see the 3rd quarter report it shows that Action Greensboro gave $5,000 to the Simkins PAC.

Under North Carolina General Statute

(a) Except as provided in subsections (a2), (b), (d), (e), (f), and (g) of this section it shall be unlawful for any corporation, business entity, labor union, professional association or insurance company directly or indirectly:
(1) To make any contribution to a candidate or political committee or to make any expenditure to support or oppose the nomination or election of a clearly identified candidate;
(2) To pay or use or offer, consent or agree to pay or use any of its money or property for any contribution to a candidate or political committee or for any expenditure to support or oppose the nomination or election of a clearly identified candidate; or
(3) To compensate, reimburse, or indemnify any person or individual for money or property so used or for any contribution or expenditure so made

The Action Greensboro $5,000 contribution to the Simkins PAC was reported under line 6 which is contributions from indviduals. Please explain how Action Greensboro is a contribution from a indvidual? It is also illegal for a professional association, corporation or business entity to contribute to a political committee. Please explain how Action Greensboro gave $5,000 to the Simkins PAC?Action Greensboro is a 501c-3 organization, can a not for-profit organization give to a PAC?It is also a limit of $4,000 to give to a North Carolina registered PAC, How can Action Greensboro give $5,000. These are the questions that need to get answered.

TRIADWATCH will be sending a letter to the North Carolina Board of Election on this issue and to see the legalities of this contribution to this Political Action Committee.

This cozy relationship between 2 powerbrokers in Guilford County has been talked about for a long time but to see Action Greensboro give money to the Simkins PAC either by mistake or out in the open for everyone to see, shows all the citizens of Guilford County the foxes who are guarding the hen house.

Guilford County Commissioner Linda Shaw Speaks: Is It Illegal or Ethical on What She Said? Video Embedded



During the Guilford County Commissioners meeting on April 15, 2010, Commissioner Linda Shaw had something to say about the upcoming primary, click on the embedded video above.

As you can see from this video, it seems that Guilford County Commissioner Linda Shaw thinks it is OK to say during a commissioner's meeting that if you live in Stokesdale, Summerfield, Oak Ridge and northern part of Greensboro, Linda Shaw would appreciate your vote for her in the upcoming republican primary.

This might not be illegal, but it sure is unethical for a commissioner to say this during a meeting.

The Guilford County Commissioners meeting gets televised all over the area from cable channel 8 on time warner. This is why we see some people talk about the equal time that opponents want in elections because the incumbents have a huge advantage if they are going to do unethical acts like Commissioner Linda Shaw did during the meeting, in telling people in the third district that she would appreciate their vote.

You can also hear the laughing in the background at the end and the videographer panning back to Chairman Skip Alston laughing.

This was not funny and needs to be addressed by the county attorney.

This type of unethical behavior needs to stop, and for the record the county attorney Mark Payne should completely strike what Commissioner Linda Shaw said from the record, and take it off the county web site of video.

If they repeat this meeting on cable access channel 8 then take it off as well. During the next Guilford County Commissioners meeting, Linda Shaw should state that she made a mistake and would also like to say that you can also vote for Sam Spagnola as well in the primary if you live in oak ridge, summerfield, stokesdale and northern parts of Greensboro for equal time to all candidates.

We will see what happens next, but this act by Commissioner Linda Shaw might not be illegal but surely it is unethical.

Chester Brown and Guilford County Commissioner Steve Arnold , We Know Who You Are, Video Embedded





At the March 4, 2010 Guilford County Commissioners meeting there was an agenda item below in regards to a new policy from the Guilford County Commissioners called the  Guilford County Commercial Investment Policy Program.Below is part of the application from Granite Church Street LLC.

Guilford County Commercial Investment Policy Program - Public Hearing for the purpose of receiving public input on a request that the Commissioners consider awarding an investment grant for each year for three (3) consecutive years to Granite Church Street, LLC for improvements consisting of a shopping center and retail shops at 5820-5828 Church Street. The investment grant for each of the three (3) years may be an amount up to 0.7374% of the increase in County property tax base over the amount of the property tax base prior to the qualified improvements. The projected real investment for this project based on applicant's information is estimated to be $5,628,079 with an anticipated new job creation of 164

HOLD PUBLIC HEARING ON GUILFORD COUNTY COMMERCIAL INVESTMENT POLICY, after which take the following actions:



1. Consider a commercial investment grant for Granite Church Street, LLC for its development at 5820-5828 Church Street for three (3) consecutive years. Consistent with the Commercial Investmnet Policy, the investment grant for each of the three (3) years may be an amount up to 0.7374% of the actual increase in County property tax base over the amount of the property tax base prior to the qualified improvements. The investment grant for this project based upon applicant's information is estimated to be $41,504 per year (an estimated total of $124,504 for three years).


2. Authorize the County Manager to execute an agreement consistent with the Guilford County Commercial Investment Policy to provide public funds in an amount up to 0.7374% of the actual increase in County property tax base over the amount of the property tax base prior to the qualified improvements. Terms of agreement consistent with Commercial Investment Policy and subject to staff approval.

 The Greensboro News & Record had a article out with a title "Incentives Lose Favor in Tough Times" CLICKHERE . Then we find out from Vie De Malchance about just who is a part of the Granite Church Street LLC, CLICKHERE  with pictures of the proposed development in question called The Shoppes at Gunter's Crossing.

Why are we giving away taxpayer money to a project that is already going to be built and is in the process of getting built. This whole policy could be illegal anyway just check out this article in business journal CLICKHERE . Also in this article in the business journal it states this"Ernie Pearson, a Raleigh-based attorney for Nexsen Pruet, has been working with the county on its proposal." How much wasted taxpayers money did it cost to use this law firm ?Let's give the award to outgoing Guilford County Commissioner Steve Arnold for the PORKER AWARD given to a local government official who wants to waste government money on crap like this investment policy. Thanks for this gift out the door to your development cronies. 

Look at the first recipients of this policy it takes Chester Brown who is with Brown Investment Properties and looking at the Granite Church LLC is not even a owner to come in front of the county as their representative.Then we come to find out that Greensboro City Council member Robbie Perkins is a part of the ownership team along  John Stratton who had a contentious rezoning case with property on the corner of cornwallis and elm street in Greensboro here is a post about the relationship of Stratton and another Greensboro council member Zack Matheny CLICKHERE

In the video above you will hear County Commissioner Steve Arnold say this about Chester Brown," please state you name and address although i am sure we all already know".The cozy relationship between developers and the  Guilford County Commissioners can be summed up plenty in what Steve Arnold said above.We already know who you are there Chester Brown and with other developers on the county board in Mike Winstead, ex developer Steve Arnold, real estate broker Skip Alston, real estate appraiser Kirk Perkins,real estate broker John Parks, Billy Yow well driller for the developers and last but not least Linda Shaw who is not a developer but sure is cozy with them .

It is time to shine a little light on our Guilford County Commissioners because in a upcoming post you will see how Commissioner Billy Yow tried to take the ethical step in recuse himself from the above incentive grant but Commissioner Kirk Perkins could not understand what a conflict of interest was and is. More post to come on this issue.

Above you will see the text messages from Greensboro City Council member Robbie Perkins to local developer Roy Carroll. During this last council meeting on December 15, 2009 it was discovered that Robbie Perkins was texting back and forth to Roy Carroll about a situation involving a court case which is totally a separate issue and a condemnation of Kotis properties to put in water and sewer to Roy Carroll's property off of horse pen creek road.

The first issue that needs to be addressed is should council members be text messaging during council meetings? The answer should be NO because the council members need to be concentrating on who is speaking to them and the case in front of them and not text messaging their friends or in Robbie Perkins case your TREBIC which stands for the Triad Real Estate and Building Industry Coalition buddy.

The second issue is to see if Greensboro City Council member Robbie Perkins is also Roy Carroll's leasing agent for this property off of horse pen creek road? If Yes ,then the councilman needs to recuse himself from yet another case that comes in front of the City of Greensboro. To understand the above text messages in the first text message it talks about a person by the name of winfree, that happens to be Kotis Properties lawyer in Chick Winfree. The third text says that is has been tabled till January 5, 2010.In the fourth text it states that "Al" has been giving me the play by play. Al is probably, Al Leonard who is Vice President Carroll Commercial Construction Company and Carrolland Company.And the last text seems like Robbie Perkins saying to Roy Carroll to go toe to toe with Kotis Properties. The "Terry" in the last text is Greensboro City Attorney Terry Wood.

A lot of this came out in front because we had a airplane incident over the summer where local developer Roy Carroll wanted to fly the Mayor of Greensboro and chairman of Guilford County Board of Commissioners Skip Alston to Washington D.C. , well some of us including this blog wanted to say that this was completely unethical for this to happen CLICKHERE for that post on July 10,2009 titled "Greensboro City Attorney Advised That Trip To D.C. Raises Ethical Concerns for Mayor of Greensboro and County Chairman. Then
on July 16, 2009 we have this post CLICKHERE titled "Roy Carroll's Company + City of Greensboro are Defendents in a Court Case As We Speak, Any Ethical Questions Now?. Now we fast forward to the end of year where the city now wants to condemn Kotis Properties for water and sewer to Roy Carroll's companies and we have a sitting Greensboro Council member text messaging the president of the company while the council meeting is going on. Amazing.

Hopefully the Mayor of Greensboro Bill Knight will make sure that all council members turn off their cell phones and not look down at their blackberry's of I phones during council meetings.

We also need to let the court case run it's course on this issue because it seems that the city attorney Terry Wood has sided with Roy Carroll on this issue and the reserve strip is acceptable but to Kotis Properties it is not but we see that Greensboro City Council Member Robbie Perkins has advised Roy Carroll that "Terry was forthright, you and marty should go toe to toe on Jan 5".

Who Are The Usual Suspects on The Greensboro Downtown Consolidated Plan Core Group?


Donald Patterson from the Greensboro News & Record has a article on September 7, 2009 with a title."Plan Will Set Priorities for Downtown" CLICKHERE . In the article this was said"The group is working through a 15-member team that includes Mayor Yvonne Johnson and Melvin “Skip” Alston, chairman of the Guilford County Board of Commissioners"
Below the fold you will see the list of who is actually on this 15 member Downtown Greensboro Colsolidated Plan Core Group ,with a slew of the "USUAL SUSPECTS" on this core 15 member group. Could we just rename the City of Greensboro, BRYANBORO or MELVINBORO or SIMKINSBORO and be done with it. It is also nice to see that the most politically connected developer in town gets a prime seat on this core group in Roy"Can I Offer You A Plane Ride" Carroll.

This Trip on Local Developer Roy Carroll's Plane Stinks To High Heaven

Failing the sniff test?
That may be so, steamed High Point blogger Keith Brown, but this trip "stunk to high heaven."


At issue is the fact that Carroll does business with the city and county governments. He received tax incentives from both entities to help build a new 17-story downtown tower, Center Pointe. Could his generosity with the free flight curry favor for him with elected leaders in the future?


It's a fair question. Yet, in times like these, public-private partnerships are especially valuable and necessary. "If we have private businesses that are willing to help get our elected leaders to a location to bring dollars back to Greensboro, then, by golly, we ought to do it," Sanders said.


There certainly is plenty of precedent for such partnerships in recent years. For instance, the nonprofit economic booster group Action Greensboro footed the bill for jet trips to Oklahoma City for citizens and city leaders in 2002, and Columbus, Ga., and Chattanooga, Tenn., in 2001.


As long as those relationships are up-front and transparent, shouldn't they be permitted for the common good they promote?


In the case of Carroll, yes, he has received incentives and, as a developer, yes, he does periodically come before local boards on zoning matters. But his company is not involved in the South Elm/Lee Street development. "He has no vested interest in what is happening on that site," Sanders said. "All he was trying to do was to be a good citizen."


Let me explain that the quote "stunk to high heaven" was in a email exchange with the News & Record so if you ever send a email to them you might just get quoted with anything you say.

As we have seen from the above quote from Walker Sanders from the Community Foundation he states that Roy Carroll has no vested interest in what is happening on this site.But let's take a look at what was reported in the Triad Business Journal paper edition July 10-16 2009 called Triad Talk from Justin Catanoso with a title on front page "Sanders Simmers Over an Opportunity Wasted" here is what was in the article:

"The normally affable and easy-going Walker Sanders was fuming this week, disappointed that a tough-to-coordinate trip to Washington, D.C., fell apart due to perception problems, and downright angry that too many people in Greensboro “seem to spend more time killing deals than trying to make things happen.”

You say perception problems others say ethical problems just ask the Greensboro City Attorney Terry Wood who said this in the editorial,"City Attorney Terry Wood disagrees. "Regardless of what (the School of Government) says, I'm pretty sure I'm right," said Wood, specifically of General Statute 133-32 that forbids any contractor who "has contract with a government agency" or "anticipates bidding on such a contract in the future" to provide gifts to elected officials who decide on such contracts.
"I am sure this is all well-intended," Wood said, "but Roy Carroll is a contractor with the city."

Then if you read more of the story in the business journal ,this is what was said about this whole elm street project" Essentially, the deal looks like this. The school system would sell the 16 acres it now occupies in Fisher Park, along with other properties around the county , to private developers. The new property tax revenue generated from those sales would help pay the school system's portion of the bonds floated to build the new 250,000-square-foot headquarters on South Elm. City and County bond funds would also pay for the building."

It would be interesting to know just who the private developers are who are going to get the land swap deal from the school system as stated in the business journal. One fact that we know is that Roy Carroll owns land a few blocks away from this property and where does he fit in to this land swap deal or private developers deal because he might not have a financial interest in lee street but he sure does have plenty of property close to the school board buildings and other properties that the school owns in the area that is up for a land swap deal or private developers deal.

Greensboro City Attorney Advised That Trip To D.C. Raises Ethical Concerns for Mayor of Greensboro and County Chairman

It is great to see Amanda Lehmert Killian or Amanda Killian from the Greensboro News & Record finally report on the latest happenings with local developer Roy "North Carolinians for Leadership in Government Political Action Committee" Carroll and his unethical use of his private plane for local elected officials to travel to D.C. .

This all started when ed cone had this to post at his blog CLICKHERE

all of this happened on June 30, 2009.

Later in the week on July 4, 2009 Triadwatch had this post with a title"Developer Roy Carroll's Plane Will Sit on Tarmac While the Mayor and Chairman Ponder Ethical Standards." CLICKHERE

News 2 and reporter Justin Quesinberry on July 6, 2009 did a complete puff piece on this whole affair , CLICKHERE but one of the interesting apsects of this puff piece was that the city and county attorneys were the city staff who had problems with this local developer who has and still does business with the City of Greensboro.

Now on July 10, 2009 the Greensboro News & Record has a article with a title "City Attorney Advised Against Trip Over Ethical Concerns." CLICKHERE .

Here is a few excerpts from the article

"Johnson said she was comfortable with making the trip after she learned that Carroll has no financial stake in the project.

"I guess that’s why you have lawyers. You try to listen to them,” she said. “You don’t want people to have any question in their minds whether you are doing what is right or ethical.”

Wood said he discussed the issue with the county attorney and the University of North Carolina School of Government.

Although legal opinions about whether the trip would violate the law vary, Wood said it was his opinion that City Council members and county commissioners, as government representatives with contracting authority, should not go on the flight.

To hear the Mayor of Greensboro Yvonne Johnson say that since local developer Roy Carroll had no financial interest in this property she was comfortable being on his personal plane to D.C. is a complete ethical lapse of judgement . As we all know there is a fall election coming up and she has some real competition in Bill Knight and to hear a sitting Mayor not understand the ethical aspects of this trip and why local elected officials should not be on this trip on a major donor to the mayor's campaign who has gotten tax incentives from both the city and the county as well. This is a good example of what is wrong with these local elected officials and some Community Foundation members like Walker Sanders and Lynn Wooten who don't understand the ethical apsects of this trip.

It is also interesting to note that there hasn't been one quote from the chairman of the Guilford County Board of Commissioners in Skip Alston about the postponing of this trip.

The Community Foundation of Greensboro had this to say in article

"The foundation is baffled as to how the flight could have been construed as a gift, spokeswoman Lynn Wooten said.
Carroll offered to let the foundation use the plane before it was clear who might travel to Washington on the trip, Wooten said."

It is fine and dandy for local developer Roy Carroll to offer the plane to take as many people as you want on this plane trip to D.C. like Uma Avva, David M. Ball ,Jon Bell, Louise F. Brady Chair-elect ,Chester H. “Trip” Brown, Jr. ,Kent J. Chabotar ,Sue Cole ,Elizabeth Cone ,Mona Edwards Chuck Flynt, ,William Geter ,Patrice A. Hinnant ,Kathy Hinshaw ,Tomasita Jacubowitz ,Joyce Johnson ,C.C. Lamberth ,Robert E. Long Jr. ,Kathy Manning ,Ken Miller ,Norman G. Samet ,Mable Scott ,Linda E. Sloan ,Andrew Spainhour Dennis G. Stearns ,Stuart A. Taylor ,Jerry Tolley ,Jonathan Wall ,Ed Whitfield ,James T. Williams, Chair ,Lea E. Williams ,Otis L. Wilson, Sr. ,David M. Worth andAnn B. Zuraw . But don't take any local elected officials because it is completely unethical to have a local developer who has business in front of the Greensboro City Council and the Guilford County Board of Commissioners plenty of times in the past and I am sure plenty of times in the future on a unfettered access plane trip to D.C. to meet with the federal officials in D.C..

Developer Roy Carroll's Plane Will Sit on Tarmac While The Mayor and Chairman Ponder Ethical Standards


In the Greensboro News & Record online edition here is the headline "Community Foundation Delays D.C. Trip", CLICKHERE . In the article this is what was said from the Community Foundation

“Questions have been raised as the result of the misperceptions of some regarding the use of this donated plane,” the statement said. “While we are disappointed by the misperceptions this travel plan has caused, more importantly we value the public’s trust and do not want to do anything to damage that trust. Therefore, we are postponing the trip.”also in the print edition that came out on July 4th 2009 this was below the title of article,
"Some questioned the ethics of using a foundation member's jet" , Triadwatch was all over this aspect of the trip to D.C.

Earlier in the week Triadwatch had this to say about this whole ordeal.

Is it ethical and or legal for a local developer who already got tax incentives from both the greensboro city council and guilford county commissioners flying local elected officials to Washington D.C. ?


How will Roy Carroll report this on his political action committee?

Local elected officials need to be understand what ethical standards are and this trip on a major campaign donor and major developer in Roy Carroll's plane stunk to high heaven. If Mayor Johnson and Guilford County Chairman Skip Alston want to fly to D.C. then use your expense travel budget money that each of you have as a elected official to fly commercial up to D.C. if it is that important to meet with federal officials.


It is time for all local elected officials to understand this will not pass muster seeing a major campaign contributor and developer offering his plane for a trip to D.C. for any purpose whatsoever. As you can see from the delay in the trip someone got to them to explain to the local elected officials it wasn't going to fly with the citizens of this area.

Greensboro Mayor Amends 2007 and 2008 Campaign Forms for Second Time

Greensboro Mayor Yvonne Johnson has had to amend her 2007 and 2008 Campaign Contribution forms for the second time in the past month. This all started when Triadwatch was looking at the Mayor's campaign forms and noticed that in her 2008 Mid Year report she had a negative balance of -($3,087.56) then you proceed to see her 2008 year end report CLICKHERE then proceed to yvonne johnson on list of candidates, it shows at positive balance of $12,049.01 with no reporting of any contributions from individuals or PAC's for the whole year only expenditures that equaled $2,551.40.

How can a candidate go from a negative to a positive balance with no contributions being brought in? This was the question to the Guilford County Board of Elections. But as the late, great Billy Mays would say " But Wait There's More" .

If you want to see the campaign contribution forms for 2007 CLICKHERE then proceed to Yvonne Johnson this will show you that the Mayor's 35 day report was amended twice and also the 2007 year end semi annual was amended twice with the mayor's treasurer last amending the forms on 6-9-2009.

While we are on the subject of Mayor Johnson's 2007 Year End Semi Annual report . Triadwatch has also found a huge discrepancy in her contribution information not given to the Guilford County Board of Elections. North Carolina election laws states the following below


NCGS 173-278.11 states

(1) Contributions. – Except as provided in subsection (a1) of this section, a list of all contributions received by or on behalf of a candidate, political committee, or referendum committee. The statement shall list the name and complete mailing address of each contributor, the amount contributed, the principal occupation of the contributor, and the date such contribution was received. The total sum of all contributions to date shall be plainly exhibited. Forms for required reports shall be prescribed by the Board.

As used in this section, "principal occupation of the contributor" means the contributor's:a. Job title or profession; andb. Employer's name or employer's specific field of business activity."

Let's take a closer look at Mayor Johnson's 2007 year end semi annual campaign contribution report.
There were a total of 46 individual contributions given and out of those 46 as stated above 40 of those forms were left empty. On top of the 40 out of 46 with the above statute there were 7 missing addresses. There was also a unusual contribution from a company called click and pledge for a total of $188.94,if these new ways of giving are going to be used in future then they need to start providing the information to the treasurers as to who gave the $188.94.

The municipal election for Greensboro is just around the corner and the treasurers of all these candidates need to be aware of election law and filling out the proper forms to make sure it is filled out correctly just ask Guilford County Commissioners Paul Gibson, Skip Alston,and candidate Larry Proctor who had to amend their returns as well. The lax reporting needs to change and the time is now.

Action Greensboro Did Give Illegally to the Simkins Political Action Committee

The North Carolina State Board of Elections has came down with a ruling in the inquiry from Keith Brown to the campaign contribution of $5,000 from Action Greensboro to the George C. Simkins Jr. Memorial Political Action Committee.

Here are a few of the questions that were sent to the North Carolina State Board of Elections.

#1 Is the maximum contribution $4,000 per cycle?

YES

The Simkins PAC and Action Greensboro violated North Carolina General Statute 163-278.13 where the maximum amount that can be given is $4,000 per cycle.

#2 Can a 501(c)3 non profit organization like Action Greensboro give to a PAC?

NO

Action Greensboro was in violation of North Carolina General Statute 163-278.19 because Action Greensboro is registered with the Internal Revenue Service as a 501(c)3 group and therefore is prohibited from making contributions to political action committees registered in the State of North Carolina. The next letter of inquiry should be to the Internal Revenue Service.

What happened to the $5,000 given to the Simkins PAC?

The state board concluded that this money was considered a prohibited receipt and would need to forfeit the contribution to the North Carolina Civil Penalty and Forfeiture Fund.

On March 6, 2009 a check in the amount of $5,000 was given to the North Carolina Civil Penalty and Forfeiture Fund by none other than Melvin "Skip" Alston, the treasurer of the Simkins PAC and also chairman of the Guilford County Board of Commissions and local lawyer R. Steve Bowden name was also on the letter from the state.

As reported in the past on Triadwatch, Skip Alston has his own link CLICKHERE , where you can see from past post that the Simkins PAC might need to hire another treasurer because he doesn't have a clue on campaign law or lately he doesn't have a clue on open meetings law as well.

This campaign contribution from Action Greensboro brings up a whole lot of issues that have been talked about in the past and need to be looked at more closely in the future.

Campaign laws in this state are pretty clear and the total lax reporting of our local Guilford County politicians in regards to campaign contributions need a complete overhaul. The Greensboro municipal elections are coming up in fall and I would like to suggest to all of them to clean up their reports and make sure you are following state law or it will get reported and brought to the attention of our local board or in the case of the Action Greensboro, illegal contribution to the George Simkins Jr. Memorial Political Action Committee it will need to go to the North Carolina State Board of Elections.

Letter of Inquiry to the State Board of Elections on Simkins PAC and Action Greensboro

It is time someone ask the questions that need to be answered and Triadwatch has sent a letter to the North Carolina State Board of Election. Below the fold is the letter sent to the state. This was first reported back in November on Triadwatch , CLICKHERE then fellow blogger Joe Guarino had a post titled "Action Greensboro's Pay to Play", CLICKHERE , and now this past week John Hammer from Rhino Times has a front page article titled "A Questionable Campaign Gift", CLICKHERE , hey John better late than never. This issue has brought up a lot of issues and it is time that the citizens of Guilford County start playing by the rules and laws of this state in regards to campaign laws.

Below is the letter sent to the North Carolina Board of Elections in regards to some questionable campaign gifts as the Rhino Times has titled.The letter was sent a few months ago and is still sitting in Raleigh. We will see what the State Board of Elections has to say about this issue. Stay tune.

This contribution brings up a lot of issues that need to be resolved or brought to the attention of the NCBOE. Below is a few questions that need to be addressed.

Is the maximum contribution $4,000 per cycle?

Can a 501c3 non profit organization like Action Greensboro give to a PAC?

It is listed as contributions from indviduals on line #6 under receipts, how is that possible?

Victor Farah has no job title or employers name under contributor information, is that allowable? NCGS 163-278.11 states that this needs to be provided and the best efforts for the treasurer is out the door on this treasurer Mr. Alston.

Is it also illegal for a professional association, corporation or business entity to contribute to a political committee under NCGS 163-278.19?

Also on 4-17-08 on the first quarter reports there is a outside source of funding which is a transfer of funds from a certificate of deposit, the question, is this a legitimate outside source and do they have to disclose the whole funding from this certificate of deposit or can it be a open funding tool with no indication of how much money is there to be had?

The enclosed attachments will highlight the problems with this report from this Political Action Committee.

These are some questions that need to be answered about this Political Action Committee and would like a response back as soon as possible and a e-mail to see if there is something else that needs to be done to find out about this issue with the George C Simkins Jr. Memorial PAC. Simkins PAC Fourth Quarter Campaign Contributions Are In

UPDATE: There is a letter that was sent to the North Carolina Board of Elections on the status of the George Simkins PAC third quarter returns which uncovered contributions made from Action Greensboro $5,000 and to find out how a non profit can give money to this Political Action Committee, and other discrepancies in their filings.
