(b) Prohibited Discreditable Conduct.

Discreditable conduct includes but is not limited to:

(1) acts that reflect adversely on the CPA's honesty, integrity, trustworthiness,
good moral character, or fitness as a CPA in other respects;

(2) stating or implying
an ability to improperly influence a governmental agency or official;

21 ncac 08n .0203 DISCREDITABLE CONDUCT PROHIBITED

A CPA shall perform professional services competently and shall:

…(2) exercise due professional care in the performance of an engagement;

(3) adequately plan and supervise an engagement; and

(4) obtain sufficient relevant data to afford a reasonable basis for conclusions
or recommendations in relation to an engagement.

21 NCAC 08N .0212 COMPETENCE

The reliance of the public …on sound financial reporting and advice
on business affairs
imposes on the accounting profession an obligation to maintain high standards
of technical competence, morality, and integrity.

To this end, a CPA shall at all times maintain independence of thought and action,
…promote sound and informative financial reporting,
uphold the dignity and honor of the accounting profession,
and maintain high standards of personal conduct.

21 NCAC 08N .0201 INTEGRITY

(a) …When offering or rendering …management advice,
a CPA shall be objective and shall not place the CPA's own financial interests
nor the financial interests of a third party
ahead of the legitimate financial interests of …the public
in any context in which …the public can reasonably expect objectivity
from one using the CPA title.

…(e) A CPA shall communicate in advance to a client
the scope of services or products to be rendered or referred…

21 NCAC 08N .0303 OBJECTIVITY AND CONFLICTS OF INTEREST

(a) … A CPA shall not engage in deceptive conduct.

Deception includes fraud or misrepresentation and representations or omissions
which a CPA either knows or should know
have a capacity or tendency to deceive.

Deceptive conduct is prohibited
whether or not anyone has been actually deceived.

(b) Prohibited Deception. Prohibited conduct under this Section
includes but is not limited to deception in:

(1) … maintaining employment;

(3) obtaining …retired status, or exemption from peer review…

21 ncac 08n .0202 DECEPTIVE CONDUCT PROHIBITED

(a) … A CPA shall not act in a way

CPAs who engage in activities regulated by other federal or state authorities
(including but not limited to the following agencies: …State Bar,
North Carolina Secretary of State, …State Auditor, State Treasurer,
or Local Government Commission)
must comply with all such authorities' ethics laws and rules.

(b) Prima Facie Evidence. A conviction or final finding of unethical conduct
by a competent authority is prima facie evidence of a violation of this Rule.

Greensboro Mayor Robbie Perkins Recuses in '09 but Votes in '12 on Richie Rich Roy's Center Pointe



Here we go again where back in 2011 we had  Greensboro City Councilman Zack Matheny recuse himself from voting on the white street landfill because of a conflict with one of the companies in D.H. Griffin then months later vote to award a contract to D.H. Griffin at the Greensboro Coliseum with a post titled "Greensboro Councilman Zack Matheny Did Not Recuse Himself on DH Griffin Item at Council Meeting" which happened back in December of '11.

Now we have the Mayor of Greensboro Robbie Perkins who is doing the same thing as what Councilman Zack Matheny did last year where they have selected understanding of what a recusal is and also with a very competent Greensboro City Attorney back in 2009 in Terry Wood said to then councilman Robbie Perkins "yes" you do have a conflict of interest and need to abstain from the vote as you see from video below

Mayor Johnson introduced a resolution authorizing an encroachment agreement with Park View Development

LLC into the City’s right-of-way and sidewalk easement adjacent and contiguous to Center Pointe along Friendly

Avenue. City Manager Johnson indicated that the resolution was required due to a change in corporate name.

Councilmember Perkins indicated a conflict of interest and his desire to abstain from voting. Councilmember Bellamy-

Small moved to excuse Councilmember Perkins from voting on the item. Councilmember Matheny seconded the

motion which was adopted by voice vote of Council. Councilmember Bellamy-Small moved adoption of the

resolution. The motion was seconded by Councilmember Matheny; the resolution was adopted on the following roll

call vote: Ayes: Barber, Bellamy-Small, Groat, Johnson, Matheny, Rakestraw, Wade and Wells. Noes: None.

Abstention: Perkins.

So as you can see then councilman Robbie Perkins was a abstention from the vote.

"The Greensboro City Council needed to vote again on Roy Carroll's building encroaching into the sidewalk in downtown Greensboro because Roy Carroll renamed the project Park View Development. The funny aspect was to hear Robbie Perkins actually ask the city attorney Terry Wood since my company is the leasing agent for this project and he said ," Does that constitute a conflict of interest" . Well Robbie Perkins I would hope so, good lord did you take a class at Fuqua called the art of no conflicts in local government."

Now let's go to the April 3, 2012 Greensboro City Council meeting where this item came up in front of council

26. Ordinance in the amount of $218,714 amending the Fiscal Year 11-12 General Fund Budget for the appropriation of a pass through economic development grant from Guilford County to Park View Development, LLC.





In the above video you will see the Mayor ask City Attorney Waterman about the conflict and he says you can vote on this item. You will then see George Hartzman ask if the Mayor is the leasing agent for the bottom floor of  Center Pointe and you need to recuse yourself and explains why he needs to do so. Spot on from George Hartzman on this point.

How can you have a conflict in '09 then now on top of being local developer Roy Carroll's personal leasing agent you actually now live in Center Pointe then not recuse yourself from this vote at the April 3, 2012 Greensboro City Council meeting?


I would suggest that this agenda item be revoted like Zack Matheny had to do and seeing that mayor Perkins does have a conflict of interest and in the future when we see any item come in front of Greensboro City Council from local developer Richie Rich Roy Carroll than we also need to see Mayor Perkins recuse himself from these items like we will see at the next council meeting where this will be on agenda:

 12. Resolution calling a public hearing for April 16, 2012 to consider requests from developers for public participation in corporate parks in or near the City of Greensboro in accordance with the Urban Development Investment Guidelines

Local developer Richie Rich Roy Carroll wants over $5 million in economic bond money for his property in eastern unincorporated Guilford County not City of Greensboro . Why should Mayor Perkins recuse himself from this vote is because as we see from Richie Rich Roy Carroll's  property off of Horse Pen Creek Road in Greensboro  it is not that the Mayor needs to recuse while the property is in the zoning phase of coming in front of council it is that after the fact you will see Mayor Perkins signs litter the property from Richie Rich Roy Carroll because the Mayor is his personal leasing agent and am sure not all of this property in Eastern Guilford County will be a business park but will need to be leased by Mayor Perkins company NAI Piedmont.

Greensboro City Council Member Zack Matheny Wants Citizens To Buy Tickets, But His Are Free, any Ethical ?




During the Greensboro City Council meeting on 1-4-2011, at the end of the agenda when each council member gets time to talk about anything they wish to, Councilman Zack Matheny invited everyone to come to some family events that were going on at the Greensboro Coliseum.


In the above embedded clip, Zach talks of if attending the Ringling Brothers Circus, then "ALL NON CITY COUNCIL MEMBERS WILL HAVE TO PURCHASE TICKETS TO THIS EVENT".

Why did Zack Matheny have this to say about the circus?

It is because when Danny Thompson first was elected to council during their meeting last year, he said the following in the embedded clip.


"Free Tickets to the Circus Handed Out by Greensboro CIty Council Members, Is This Legal, Ethical or Conflict of Interest"

Now we come full circle where a sitting councilman is admitting that he is getting free tickets to the circus and telling non council members that they have to buy their own tickets.


Does anybody see these free tickets for sitting council members as unethical?


Who is actually giving these tickets, and is it legal under state law?


Should freebees be reported?


How many other events are the sitting council members getting free tickets too that they are not telling us about?

If anyone is going to the coveted ACC Tournament this year, please inform the public of which sitting council members happen to be in audience, because it would be interesting to see if they paid the $400 or so dollars for a book to get into this tournament, or what other arrangments were made.

Free tickets to the Greensboro Coliseum to sitting council members needs to be off limits for plenty of reasons but it doesn't seem to bother our local politicians on this matter as seen from above.

Greensboro City Council Member Zack Matheny Did Receive Free Tickets To Greensboro Coliseum Video Embedded

During the November 9, 2010 Greensboro City Council meeting, fellow contributor to TRIADWATCH George Hartzman spoke to council members on a agenda item which turned into talking about them receiving free tickets to events at the Greensboro Coliseum. As you can see in the above embedded video we now have Greensboro City Council Member Zack Matheny on record telling everyone that he did receive free tickets to the Greensboro Coliseum.

This all started back February 20, 2010 with a post titled "Free Tickets to Coliseum Handed Out By Greensboro City Council Members, Is This Legal, Ethical or Conflict of Interest?" CLICKHERE .
This is where Greensboro City Council member Danny Thompson thanked fellow council members for letting them have their allotment of circus tickets for him to use.

Now this past week when George Hartzman asked the question again we have Zack Matheny go on record as saying he received and used the circus tickets free of charge . Will the local media talk about this issue probably not because everyone one of them are also on the free ticket trough with barter agreements from print, weekly newspapers and news 2. This is serious stuff where we have a local ABC General Manager getting fired for receiving free meals and tickets  but not any ramifications or policy changes when the Greensboro City Council members receives free tickets to events out at the Greensboro Coliseum. The Greensboro City Council on a regular basis votes on plenty of issues in regards to the Greensboro Coliseum and knowing that they get free tickets to events out at coliseum is completely unethical and should be abolished.

2 Guilford County Commissioners Tell Randall Kaplan from Downtown Greensboro Hotel What They Think About Economic Incentive's in Future

During the September 16, 2010  Guilford County Commissioners meeting all the talk was about approving the federal recovery bonds for a new downtown luxury hotel which will be called Wyndham Greensboro. During this agenda item we had our own Triadwatch contributor George Hartzman speak his mind and asked a few questions CLICKHERE thanks FEC at Vie De Malchance.

One of the most unusual aspects of this agenda item was hearing what both Guilford County Commissioners Kirk Perkins and Linda Shaw had to say about something that will probably come back up in front of the county commissioners and probably as well the City of Greensboro which is economic incentive money offered by the local municipalities.

Here is what County Commissioner Kirk Perkins had to say,




As you can see from the video embedded above, the commissioner tells Randall Kaplan from the local group who wants to build the luxury hotel that, "hopefully they won't apply for the economic incentive policy , hopefully if they do we will turn them down but certainly if it is available then they should go for it."
That sounds like a shot below the belt from a county commissioner saying to them don't even think about coming back in front of council to apply for the county economic incentive policy .

But wait there is more because another Guilford County Commissioner in Linda Shaw had something to say as well here is the embedded video below.




The commissioner talks to Randall Kaplan and asks him if he is going to come back in front of us to ask for more money because we are going to stop you right now on incentives. In the video you can see a bewildered look on Randall Kaplan's face in regards to this issue.

It was interesting to see 2 county commissioners come out even before they ask for incentive to let the hotel group know that they can apply for the incentives but might have a hardtime getting approval.

It will also be interesting to see them try to get incentive money out of the Greensboro City Council as well.

One thing that might become a issue is hearing at the commissioner's meeting where Randall Kaplan from the hotel group talked about them being a good tenant for a parking garage in downtown Greensboro but maybe both the Guilford County Commissioners and the Greensboro City Council who will see the economic incentive application can put on a restriction that any incentive money will go towards the building of a parking deck near the hotel and that part of elm street.

Now that this project is on the fast track for completion and needs to start breaking ground soon, it will be fun to see the Wyndham Greensboro owners come back in front of the local municipalities with their incentive package and see if they have the votes for it to pass because these 2 commissioners were trying to say to Randall Kaplan you probably don't have my vote if you come back in front of us.

Changes to ABC Board in Mecklenburg County , Will Greensboro Do Anything or Play The Delay Game?

According to a new post at blog called Pundit House titled "Big Bucks for Booze Board," Mecklenburg County N.C made a complete overhaul of their local Alcoholic Beverage Control board. At the end of the post this is what was stated:

"Along with the salary adjustments, commissioners also approved other tweaks to ABC oversight and operation: the local board must submit a monthly copy of law enforcement activity report to the board of commissioners; submit an annual balanced budget to the board of commissioners and hold a public hearing before adopting a budget; conduct an annual financial audit and present it to commissioners for review; receive commission approval for any salary increase for the CEO; and obtain advance approval from the county finance director for any ABC Board travel expense that exceeds $1,000."

When will we see our local Greensboro ABC control board take on the issues raised with this report from July 14, 2010 from Mark Binker at News and Record? Here is a link to original report CLICKHERE . Below are some of the allegations,

The report by Alcohol Law Enforcement Officers details several things of value they say Alley inappropriately took from liquor industry representatives. Alley says some of reports findings are wrong and others fell within generally accepted business practices.


Among the reports findings, Alley is alleged to have:


-accepted more than 70 meals from liquor company representatives.
-accepted and/or free lodging from liquor company representatives for travel in New York and California.
-prevailed on liquor industry contacts to obtain free or discounted liquor for personal use.
-collected mini-bottles meant for sale as premiums with regular liquor bottles, giving them to favored employees or taking them for herself.
-reported some bottles of high-end liquor as damaged but keeping them for herself rather than disposing of the liquor in question.
-taken home parts of in-store displays that should have been returned to liquor companies, including bar stools and an electric fireplace.
-ordered employees to forge to the signature of the Greensboro ABC Board chairman on a financial disclosure document


Close to 2 months have passed and not one peep has been heard out of the Greensboro City Council on the allegations against local ABC board general manager Katie Alley.

I want to give out my George Hartzman question for the day to end this post, and it is a question to General Manager Katie Alley.

As you can see from the report, you had accepted well over 70 meals from liquor company representatives, and during this whole process of going out to eat with the representatives, did you ever pick up the tab for one meal during this whole time?

If the answer is yes, please release the receipts.

Katie Alley expected the liquer distributors to pick up the tab. Hopefully, more information will come out on this issue . The local Greensboro ABC board is circling their wagons around Ms. Alley to protect their monopolistic empire of extorted favors, instead of cleaning house, which is what Charlotte and Mecklenburg County did.

Maybe it's time for our local elected leadership to step up to the plate and call for some reforms, even though they recieve the same treatment from campaign contributors with business before our legislature.

Maybe that's why they haven't.

If the county spends down to thier reserve limit this year,
where are they going to get the $27,502,224
for increased principle and interests payments in 2011/12?

So if the county goes down to the reserve minimums this coming year,
will they have to cut the $34 million of no more reserves to raid
and then another $27 million from the budget for debt
on top of $4 million more for 80 new detention officers in 2011/12?
