EGBAR MELVIN Fills Out Push Poll Questionnaire from TREBIC, NAIOP,TAA,GRRA,and GBA Special Interest Groups

The Triad Real Estate and Building Industry Coalition(TREBIC) along with NAIOP the commercial real estate development association along with the Triad Apartment Association along with the Greensboro Regional Realtors Association along with the Greensboro Builders Association have a push poll questionnaire for all the candidates to fill out in the upcoming fall Greensboro elections.

Remember all of these same organizations were wanting to deny the citizens of Greensboro the right to Protest Petitions in the zoning process all last year and fought all the way till the end with the help of the Greensboro City Council on this talk of a compromise with the above organizations on state law. But as we have seen CLICKHERE the bill was passed on 3-5-09 with no compromise.

It is also noted that the questionnaire has the labels of all the above special interest groups but not TREBIC but at end of form you need to send in the form to TREBIC, odd.

Hey, Bailout, answer Jerry's question. Would you rather not know anything about the person you are voting for? Can you blame anyone for trying to get to know the candidates prior to casting their vote? Further, you don't know that the public will not be able to view the candidate's answers (though you have now problem representing your unfounded guess as fact). If you are so worried about viewing the candidates answers, you should quit your whining and submit your own questionnaire.

It's hopeless, TriadWatchTruth. He can't seriously answer anyones questions much less correspond with city officials because he lacks the basic intellect needed to carry a straight, knowledgeable discussion about profound issues. According to the News and Record, Mr. Bailout Brown is a High Point resident. So, he can't even vote in the election! Interestingly enough, he has no problem dogging our city, our citizens and our progress. I'm never to return to your site. You have no business in our city; you don't even pay Greensboro taxes.

nice try on my motives because they have always been for the citizens of greensboro not the special interest and if you want any proof then all you need is to know that i was one of only 9 people who actually showed up to understand the land development ordinance committee meeting tonight at leonard recreation center and you wait and see how neighborhoods are not getting a fair chance in the zoning process thanks to the likes of TREBIC.

It looks to me like the author here is trying to create a story out of thin air rather than report on what's really out there. No one said anything about your motives, just the way you go about "helping the citizens". And do you not understand that special interest groups are? The exits to represent groups of citizens in greensboro. The protest petition initiative that you support is, in fact, a "special interest group". It represents the special interest to petition. You're a hypocrite. You also conveniently forgot to include that Trebic includes two area non-profits -- Affordable Housing Management and the Center to Create Housing Opportunities. "Non-profit" means they make no profit, or have no business interest, except to make sure that people in tough economic times have a roof over their head.

Nope it is state law that was denied to the citizens of greensboro for over 37 years.

What is guy talking about? The petition is law now because a special interst group lobbied for it! You participated in the group of citizens that pushed for the protest petition law that passed. Thus, that makes you part of a group with the special interest of passing a particular law. So, your no differet than any other special interest group. You both use influence to advance your belief. Only difference is you make up, conceal and mis-state facts to advance yours.

It's not like Trebic is perfect, but I fail to see how they are evil as you and your nonsense questionnaire makes them out to be. Their members have done alot for our city. Not everyone may think what they have done is the "best", but no-one argues that greensboro isn't progressing. It's progress has a lot to do with the trebic members. You should give them some credit. No one is saying you shouldn't oppose them, but, you should acknowledge their value and make legit arguments against them.

ok here is my logic against trebic, every citizen in this whole state of north carolina who lives in a municipality had the right to use protest petitions in zoning cases , it is state law under 160a385 and 386. Not one politician could explain the reasons for this exemption of Greensboro back in 1971.

Now you have trebic and all the ones on the top of this questionaire denying the citizens of greensboro the right to use this valuable tool in the zoning process all the way till the end. It made no sense for them to deny the citizens of greensboro this state law and as you can see it passed the general assembly real quick.

Egbar Melvin is a fictional character who has roots with this post.

Noone denied their right to petition. The citizen intiative petition was in place. Trebic thought it was too much power in a 5% minority. Fair argument. Look at the good Trebic has done. Why don't you write about that?

The Protest Petition is going to come back and bite you and everyone else in the ass, Keith! When the city tries clean up development and regulate developers in commercial areas, it will only take 5% of in the 100 ft. buffer to require super majority! 5% could be as little as 1 person if there are only a couple of parcels of property that fill the buffer area. Why do you think uptown charlotte is growing so fast! Because all the developers own all the land and essentially veto every attempt at quelling their power! Who's side are you on here. Now Trebic can just protest all the legislation that comes downtown bc it owns all the property there. Plus, as you claim, Trebic has the council in their pocket, so you'll never pass a 7-2 vote for contested zoning regs that disfavor Trebic! Didn't think about that did you, jackass. The Cartel will reign forever now. What do you say to that?!

The protest petition won't come back to bite me in the ass. But i am sure you will lead the charge in crying to the state about the this being the tyranny of the minority.

You should consider that, triad. You want more regulation on out of control developers, right? So, when the city tries to do that, all the developers have to do is get 5% to invoke the super majority. Please explain how I am wrong.

What? You need to read what's being said. The reason anon says Charlotte is developing like it is, is because the developers are able to require super majority by getting together and protest petitioning any regulations that affect their property values. That's a real possibility. What is the problem with changing zoning classifications of homes? Do you even know what that means or what affect that will have?

One technique the city uses to take away development rights is to rezone or classify an area as historic. The developers can stop this with a petition.

its not just rezoning...the petition can be used for "any amendment to the zoning map". That means any overlay, design control, rezoning, variance, etc.

§ 160A‑385. Changes.

(a) Qualified Protests.

(1) Zoning ordinances may from time to time be amended, supplemented, changed, modified or repealed. In case, however, of a qualified protest against a zoning map amendment, that amendment shall not become effective except by favorable vote of three‑fourths of all the members of the city council. For the purposes of this subsection, vacant positions on the council and members who are excused from voting shall not be considered "members of the council" for calculation of the requisite supermajority.

(2) To qualify as a protest under this section, the petition must be signed by the owners of either (i) twenty percent (20%) or more of the area included in the proposed change or (ii) five percent (5%) of a 100‑foot‑wide buffer extending along the entire boundary of each discrete or separate area proposed to be rezoned. A street right‑of‑way shall not be considered in computing the 100‑foot buffer area as long as that street right‑of‑way is 100 feet wide or less. When less than an entire parcel of land is subject to the proposed zoning map amendment, the 100‑foot buffer shall be measured from the property line of that parcel. In the absence of evidence to the contrary, the city may rely on the county tax listing to determine the "owners" of potentially qualifying areas.

(3) The foregoing provisions concerning protests shall not be applicable to any amendment which initially zones property added to the territorial coverage of the ordinance as a result of annexation or otherwise, or to an amendment to an adopted (i) special use district, (ii) conditional use district, or (iii) conditional district if the amendment does not change the types of uses that are permitted within the district or increase the approved density for residential development, or increase the total approved size of nonresidential development, or reduce the size of any buffers or screening approved for the special use district, conditional use district, or conditional district.

(b) Amendments in zoning ordinances shall not be applicable or enforceable without consent of the owner with regard to buildings and uses for which either (i) building permits have been issued pursuant to G.S. 160A‑417 prior to the enactment of the ordinance making the change or changes so long as the permits remain valid and unexpired pursuant to G.S. 160A‑418 and unrevoked pursuant to G.S. 160A‑422 or (ii) a vested right has been established pursuant to G.S. 160A‑385.1 and such vested right remains valid and unexpired pursuant to G.S. 160A‑385.1. (1923, c. 250, s. 5; C.S., s. 2776(v); 1959, c. 434, s. 1; 1965, c. 864, s. 1; 1971, c. 698, s. 1; 1977, c. 912, s. 7; 1985, c. 540, s. 2; 1989 (Reg. Sess., 1990), c. 996, s. 1; 1991, c. 512, s. 4; 2005‑418, s. 5.)

So, Keith, what are you saying to all the greensboro citizens who rely on the two nonprofit members in TREBIC - Affordable Housing Management and the Center to Create Housing Opportunities? Are you saying that their interest in having a roof over their head is crap? Cause that is what it sounds like. Trebic is better than no trebic at all. What kind of city do want?

"ZONING MAP AMENDMENT" you fool. This new overlay that is coming up for a vote will get protested by the so called 'evil' people that have made our downtown excellent. Hell of a lot better than high point. You think your brilliant cause you cut and paste the code? You should read it. Hilarious. All the work you have done for this petition is going to be used by the people you hate, and for no good reason except they openly offer a plane ride to bring in 15 mill and a public eduction center for our city!

Keith, I thought what you did for the protest petition was notable, whether or not you knew what you were doing or not. However, you should stray from our politics. I personally do not want you to endorse any legislation or anything for my city. You clearly have no respect or regard for reality, the truth or opposition. Greengrl, as well as many others on this blog had very good questions for you that you either dodged or attacked with child's play. Some of us thought you were a tad credible, so did the news, apparently. Well we were wrong. But you'll never convince me to get behind what you preach and you'll never get your point across again because I think no one will take you serious or respect what you say. I had no idea you weren't a citizen of Greensboro. I think that is legitimately questionable as well as every other question on your post. I think your a stain on anything good that we have going here. You're incredibly negative and despite you 5k PAC claim to fame (which was bound to come out with or with out you), you have done absolutely nothing to help us. Your sense of entitled that came from a whopping 5k breaking story, that everyone knew already, to which PAC admitted is ridiculous and unfounded. Rather, I think your mere association with the name Greensboro is damaging enough.
