Virginia- A 5th Public Notice Bill Proposed. This Bill Aims to Move Bid Notices Out of Newspapers.
A 5th Public Notice Bill proposed in Virginia last week.
Four Bills overturning the expensive and cumbersome practice of forcing public notices to be published in newspapers were proposed two weeks ago, we reported.
This past week a 5th bill was put forth. HB1193 sponsored by Delegate Ron Villanueva, addresses Requests for Bid Proposals. Notices would no longer HAVE to be published in a newspaper of general circulation.
Newspapers in the state prompted by the Va. Press Association have been editorializing strongly to vote against all of these bills.

But there are options, and the council has to make the right decisions before going to voters.

I was teaching the North Carolina Ethics Component
for the NC Bar association,
for free.
I brought up a Real Estate closing scenario for examination,
in which everyone at the table
except for the one time passing through customer
made relatively more
the larger the deal.
If you were the Real Estate Broker,
the more expensive the house,
the bigger the payday?
If you were the mgagtroe broker,
the bigger the total borrowed, the more exotic,
the more compensation involved?
If the Attorney,
the more business from those selling X,
the more Y?
etc...
About a week later,
I found out I didn't teach the NC Bar association Ethics Component
for free any more.
Same thing only different with the 1 month LIBOR based issue
the city (Robbie, Zack, Bellamy, Yvonne, Jim, Nancy and Denise?) wants to do
to borrow another $10 million, only different?
Did it look like Mary Kay and the other Nancy
were relatively uninformed of what was actually happening?
Why wasn't the city able to borrow $40 million
instead of only $30 million?
How did they get around only being able to borrow $30 million
to $40 million?
What are the risks of borrowing more
than guidelines say is allowable?
Did City Council know what many don't
about revaluations?
Do some know what probable tax increases are coming
from Guilford County?
Are some going to pay for contributors interests
instead of paying down the Lake Jordan costs?
And some want to borrow another $30 million
on top of the $40 million?
If they didn't know,
how could borrowing $10 million more than they are supposed to
be perceived
if it doesn't work out the way they hoped,
not knowing past mistakes may have been repeated?

PINBALL is Back In The Triad with New Place Called Lost Ark Video
Bob Buckley from Fox 8 WGHP with a report above titled Pinball comeback in the Triad interviewed me for this report. It was great talking to him about my passion for pinball. Growing up in Greensboro in the 70's and 80's and 90's there was plenty of places to play pinball and video games from Sears at Friendly Center to the bowling alley at Friendly Center to the 7- elevens around town and to the 2 biggest places in Greensboro to play that are no longer here in the PUTT PUTT on High Point Road and Battleground Avenue.
Now we have a great place located off of Spring Garden Street in Greensboro N.C. called Lost Ark Video which has over 14 pinball machines from the greatest pinball machine ever made in Twilight Zone to a personal favorite machine of mine in Road Show. These are just a few of the well kept pinball machines available to play.
This Saturday night at 7:30pm. on 1-21-2012 they will have their monthly PINBALL TOURNAMENT come on out for the tournament it only cost $5 to enter.

Florida- Bill to Move Foreclosure Notices on line introduced for 2012 session . $30 mill. in notice revenue at stake
Florida's Dire Financial Situation Compels Legislators to Come Up with Creative Solutions
SB 230 has been introduced for the 2012 session on January 10. It states that:
A legal publication, advertisement, or notice of foreclosure action required by s.702.035 may be placed on a publicly accessible website of the clerk of court in lieu of publication in any other form of media.
We reported on the introduction of this bill last year. Even though Florida's foreclosure volume has decreased substantially, the business is an estimated $30 million. Much of the foreclosure notice business goes to the Daily Business Review in Miami. By counting the notices it appears that close to $5-$10 million of notices is published in that publication. The owners of The Daily Business Review, Apax Partners (who it is reported has already lost $150 mill. on it's investment) and the Royal Bank of Scotland should be watching the progress of this bill very carefully.

4 December 2011-SB 230, sponsored by Sen. Steve Wise, R-Jacksonville, and HB 149 Rep. Dennis Baxley, R-Ocala, from a high level, appears as most bills do, allowing that foreclosure notices be published on a "publicly accessible web site." In addition, some specifics worth noting have not appeared in the dozens of other bills from other states we have reported.
- Some highlights as to how The bill defines a "publicly accessible internet web site":
- Be approved by the Fla. Clerks of Court Operations Corp.
- Post notices for 90 days (GOOD)
- Maintain notices for users for 10 years (NO Should be forever - Argument consistently won by newspapers focuses on the infinite ability to refer back to paper forever.)
- Receive 100K total impressions (seems like an arbitrary number given the stringent requirements of newspapers of record)
- Maintain 24 hour customer support and telephone support 12 hrs, per day. (Given how lame the customer support is at newspapers, especially the Daily Business Review, this should suffice.)
- Post in multiple languages (EXCELLENT. All newspapers should cringe from this)
- The website provider shall publish its affidavits electronically and may use an electronic notary seal. (EXCELLENT)
- So here's the bad news.
- There is virtually no cost savings to the banks or person foreclosed on.The outrageous sums of money going to the newspapers (tens of millions of dollars in Florida alone) will just go to a different party other than the newspapers. The whole point should be to lessen the burden on those foreclosed as well as publishing more comprehensive information about the property.
We reported on 2 bills proposed last year to move municipal paid notices out of the newspaper. House Bill 89 died in Government Operations Subcommittee in May of this year. Senate Bill 7204 also reached a Budget Committee where it was never considered.
It seems like committees and subcommittees do all of the dirty work in shooting down bills with no real accountability. No one really reports on what happens in these committees, the government web site just reports "died in subcommittee" with no real disclosure of why. The next level of government disclosure on web sites should be to reveal the minutes of state house committees and subcommittees.

N.J. Bill (S2072) to permit on line publishing of legal notices
NJ lawmakers have proposed on Monday, January 9, a vote on bill S2072 called the Electronic Publication of Legal Notices Act, which would permit local municipalities to post legal notices on their own web sites saving anywhere from $20 million -$70 million, it was reported on nj.com . As reported here version of this bill was approved last February by the Assembly Commerce and Economic Development Committee according the the Star Ledger . The gist of this bill is "Whenever a government agency or an individual is required by law to publish a legal notice in one or more newspapers, the government agency or individual may cause the required notice to be published on an official government notice website instead of a newspaper ..."
The bill doesn't address the key argument put forth by newspapers (independence) . If the government is hosting the notices and they have an interest in keeping something secret it isn't the case of the fox guarding the hen-house?
That said, this bill has been improved somewhat.
- the government must provide an affidavit of publication when requested free of charge
- if someone is unable to access the internet they can call up and request a hard copy of the notice
- the government must announce each year that they will be publishing notices on line.

As reported in al.com, the City of Gulf Shores, Alabama plans to stop publishing local ordinances in the local newspaper. According to state code, cities do not have to publish notices in the newspaper if the local paper is not published within the city.
