Deep Thoughts on Greensboro's Budget, by John Hammer

"Rhino Offers Budget Cut Recommendations

...eliminate the funding to Center City Park. The city has a difficult time maintaining the parks it owns.

Why on earth is the city paying to maintain a park owned by one of the richest foundations in town?

The park is the brainchild of Jim Melvin, president of the Bryan Foundation. The Bryan Foundation, through a fully owned subsidiary – Downtown Greensboro Renaissance LLC – bought the land, tore down the buildings and built the park. The Bryan Foundation had plenty of money to do all of that just the way it wanted to, not the way the city suggested it be done. Now let the Bryan Foundation pay to maintain the park. If the Bryan Foundation can't afford the park maybe it should have left that property on the tax rolls and allowed the people who worked in those buildings to continue to do so.

...Sell or give away Bryan Park golf courses. There are plenty of public golf courses around. It cost the city over $200,000 a year to maintain them. If there isn't some way to make them break even, then get rid of them.

...There is no reason for the city to have an assistant city manager and an assistant to the city manager in charge of economic development, and pay hundreds of thousands of dollars a year to the Greensboro Partnership for economic development.

The Partnership, what is called the Chamber of Commerce in most cities, operates as an arm of the Democratic Party. Greensboro has its first Republican mayor and a Republican majority on the council. Why should the six Republicans and one independent on the City Council agree to keep funding an organization that supports Democrats?

A possible budget cut would be to treat the Greensboro Coliseum like every other department. Right now the Coliseum gets $1.8 million every year to spend on whatever the management deems fit. This is how the Coliseum got in so much trouble with the City Council over the now half-built amphitheater.

Coliseum Manager Matt Brown had money in his budget and, with permission from acting City Manager Bob Morgan, the Coliseum spent $130,000 on the amphitheater without the City Council's knowledge."

As you can see from above, this email from Friday January 8, 2010 will show you the relationship between Marlene Sanford from the Triad Real Estate and Building Industry Coalition (TREBIC) and Jason Cannon from the Greensboro Partnership . Why does this email above even matter well let's take a look at a recent article in the Greensboro News & Record with a title "Commissioners skeptical about merging depts.with Greensboro" CLICKHERE this past week. Here is a little part of the article.

"Marlene Sanford is chairwoman of the Intergovernmental Planning Task Force, which has been studying a merger since April. She’s also president of the Triad Real Estate and Building Industry Coalition. She said her task force’s study found that the county can’t count on a merger saving money or making the departments more efficient, but it would make development easier once the economy turns around.



Sanford’s task force recommended a merger by the end of the year, saying the path for developers is too obstructed now."

Now we have the president of TREBIC who has an agenda and is the chairman of this Intergovernmental Planning Task Force, what a joke. Now we need to take a closer look at who are the members of this Intergovernmental Planning Task Force. Here is a closer look at who is on this committee. This task force includes people with a variety of interests to provide a well-balanced perspective on issues facing Guilford County and the cities located within the county. The primary charge of the task force is to study the pros and cons of merging the cities' planning and inspection functions with the county's planning and inspection functions. The task force will review key issues and provide recommendations to the County Commissioners and City Councils.

Take a look above at all the TREBIC members of this intergovernmental agency 10 out of 18. This is what is wrong with soo many boards and commissions in Greensboro and Guilford County the deck is stacked in their favor. As the saying goes look at the FOX GUARDING THE HEN HOUSE. To hear them say on the web site that this is a well balanced perspective is laughable.

When will see a change in the mind set on who needs to be appointed to these boards and commissions because it has become a broken record. How has it become a broken record because here is what was reported back in 2008 from the protest petition for Greensboro N.C. blog

"In the Triad Business Journal January18-24 2008 in the Triad Talk section this is what was said. " Developers always have the upper hand in Guilford County" says Reid Phillips, an attorney with Brooks Pierce in Greensboro. They have boards packed with their people. They have experience. They are masters of divide and conquer. They can also wear people out with continuances.



It is hard for grass roots efforts to compete with this modus operandi."

Also in the same post let's also take a look at what was reported back in May 22, 2008 and look at some of the members of this land development ordinance committee if you would like to see the whole article on the propoganda TREBIC letter sent to the state legislators to deny the citizens of Greensboro the right to Protest Petition CLICKHERE . Below is another part of this post.

Where can we start with this one 2 points first on how your hear them say "most developers voluntarily meet with neighbors". The key word is "most" it is amazing that there is not a requirement for the developers to meet with neighbors in Greensboro.David Wharton who is a member of the Greensboro Land Development Ordinance Committee had this to say"This might interest you: I and others tried hard to get a "meet and confer" requirement written into the new ordinance, which would require a developer seeking a rezoning to meet with the neighbors beforehand and to report to the zoning commission the outcome of the meeting.



The best we could get was a requirement that developers must report to the zoning commission on their efforts to confer with neighbors, which means that if they didn't try to meet, they have to say that."


As you can see David Wharton says the best we could get, because people like Gary Rogers with Starmount Company,Trip Brown with Brown Investment,Keith Price with Samet Companies,James Cox with Mid-City Urban,Jessica Marlies with Brooks Pierce Law Firm,Mike Fox with Tuggles Duggins Law Firm,Dick Franks with Koury Corp.,Gary Hill with McAlphine Company,Gary Wolf with SparrowWolf Law Firm, and Mary Skenes with Yost and Little. So 10 out of 14 are TREBIC members or close allies with TREBIC for the Land Development Ordinance Citizen Advisory Team. As said before by Lawyer Reid Phillips ,boards get packed with TREBIC all the time especially in Greensboro where as Mike Barber said at a Greensboro City Council meeting on April 1st "TREBIC has been contacted and TREBIC has some interest".


The other point has to do with TREBIC saying that " Protest Petition is antiquated and should be repealed statewide". It should be noted that Protest Petitions are not antiquated but the exemption of Greensboro from this North Carolina General Statute is antiquated. Let's have the State Legislators pass a bill to make Greensboro comply with this statute and then TREBIC can lobby to deny the citizens of the whole state of North Carolina their right to protest unwanted development in their neighborhood.Good luck with that endeavor.


It is also noted that they left out the condescending quote from Gary Rogers TREBIC chairman saying that Greensboro had the foresight to exempt themselves from Protest Petitions.No, Mr. Rogers, it was not foresight. It was an effort to take away a right of the citizens to use the power of petitions against unwanted development in established neighborhoods

Look at some of the same names on the ldo committee and this intergovernmental agency . Gary Wolf, Gary Hill, Mary Skenes , Keith Price and TREBIC in general. QUIT,QUIT, QUIT doing this. We saw the true colors of TREBIC when they tried to deny every citizen of Greensboro the right to Protest Petition in the zoning process. As we have seen lately it has proven to be a major part of the process in cases on elm and cornwallis plus also the spring garden zoning case with the newman buildings which will come up soon in a future case.

We still haven't even talked about the deck stacking of TREBIC on the RUCO commission .

It is time for a complete overhaul of all of these boards and commissions in Guilford County and not let these lobbying groups like TREBIC stack the deck in their favor.

…A downtown performing arts center has been the subject of at least four studies since the late 1990s and continues to have significant support. “It is the single best project we could do as far as helping the downtown area,” said Rob Johnston, president of Johnston Properties, a commercial real estate development company located in the center city. “This will be a huge amenity. Huge.”

* Continuing to improve streetscapes around downtown…

With money from taxpayers?

“Greensboro should invest in downtown development now so that it emerges from the recession stronger than its peers,” the consultant report said. “A regionally competitive downtown requires significant public support, even in healthy economic times.”

Sound familiar, like the non-independent study for the Aquatic Center etc...?

…downtown leaders will ask the City Council and the Board of Commissioners to adopt the final recommendations.

The George C Simkins Jr. Memorial Political Action Committee 3rd Quarter reports reveals a relationship that behind the scenes has been talked about but now is there for all to see .

The treasurer for the Simkins PAC is non other than Melvin "Skip" Alston Guilford County Commissioner as reported in TRIADWATCH, Mr. Alston needs to understand North Carolina Laws and how they work in regards to campaign contributions.

If you can see the 3rd quarter report it shows that Action Greensboro gave $5,000 to the Simkins PAC.

The Action Greensboro $5,000 contribution to the Simkins PAC was reported under line 6 which is contributions from indviduals. Please explain how Action Greensboro is a contribution from a indvidual? It is also illegal for a professional association, corporation or business entity to contribute to a political committee. Please explain how Action Greensboro gave $5,000 to the Simkins PAC?Action Greensboro is a 501c-3 organization, can a not for-profit organization give to a PAC?It is also a limit of $4,000 to give to a North Carolina registered PAC, How can Action Greensboro give $5,000. These are the questions that need to get answered.

TRIADWATCH will be sending a letter to the North Carolina Board of Election on this issue and to see the legalities of this contribution to this Political Action Committee.

This cozy relationship between 2 powerbrokers in Guilford County has been talked about for a long time but to see Action Greensboro give money to the Simkins PAC either by mistake or out in the open for everyone to see, shows all the citizens of Guilford County the foxes who are guarding the hen house.

Then we find out that one of Chester Brown's employees Russ Parmele VP of business development has moved right from Greensboro board of adjustment to the Greensboro Zoning Commission without any opposition . It must be nice to go from one commission right to another without any objections and to see if there has been any applications in the databank waiting to get on this board but the TREBIC connected Brown Investment goes right to the front of the line. Amazing

These are just a few of the usual suspects who will be at this Old fashioned political rally. The influence of TREBIC on the local politicians needs to come to an end. When you hear certain politicians come out and say TREBIC has been contacted and TREBIC has some interest, it only goes to show that the FOX is guarding the Hen House and each year they want everyone to know who the FOX actually is.

It states that the local elected official and candidates can get their ticket for free and complimentary.


We have seen plenty of problems on the state level with some DMV workers were given free meals just like the Greensboro ABC Manager Katie Alley who is in a little hot water for her lunch dates with vendors comping the meals for her. How is this different from the most influential lobbyist group in Guilford County TREBIC giving FREE MEALS to local elected officials and candidates right before the elections.

If you are a local elected official and do plan on going to this event it is in your best intertest to NOT take the free meal and buy a $30 ticket and run it through your campaign committee fund because to me this is accepting a free meal and should not be done. Ethics is a real issue and it is time for our local elected officials and candidates understand how this free meal is not right and if you want to attend then pony up the $30 or not go. There were two analysis performed by the same company for the Hotel project.

The first, commissioned by the City of Greensboro, dated January 18, 2010,
said average food and beverage revenues
for comparable downtown hotels in large cities ranged from $75.54 to $92.28,
while the hotel developers projected food and beverage revenues
were $115.93 per room, three times higher than the Downtown Marriott.

The second study by the same company, dated February 16, 2010,
paid for by the developers, projected food and beverage revenues
of $169.29 per room, for a hotel surrounded by restaurants, night clubs
and a ballpark.

How could projected food and beverage revenues rise
from $115.93 on January 18th, to $169.29, less than 30 days later?

How can an “independent” analysis performed by the same company
believably assert that occupancy projections rose 20% with 10% fewer rooms
inside of a month?

Are these numbers,
presented by the same company that rejected the feasibility of the hotel
less than a month before, realistic?

knew that “New Market Tax Credits”

News 2 had a report last night which talks about the RUCO inspection process that the City of Greensboro has in place and the local special interest lobbyist group TREBIC and their president Marlene Sanford want to eliminate this whole process . Time for a Reminder of Where You Can Place Political Sign Placement and Pictures of What Not To Do.

It is time for a reminder of where you can place political signs in the triad area. Above you will see the regulations for the City of Greensboro and if you would like to see Guilford County, Jamestown and High Point CLICKHERE .

 Greensboro City Council member Nancy Vaughan has some pictures of campaign signs that are in areas that are illegal here are a few of the pictures. As you will see these pictures were taken on plenty of places up and down battleground avenue with the last picture taken at the intersection of battleground and pisgah church road where there is a huge median that is owned by the City of Greensboro and the whole median is illegal to post signs on. It is time to take them down .








Greensboro City Council member Nancy Vaughan had this to say on Facebook,

I am stunned by the number of illegal election signs! It is illegal to place signs in traffic medians or traffic islands. All Don Vaughan, NC Senate signs are placed with the landowners permission. If you see one of Don's signs in an illegal location you have our permission to take it down. I challenge other candid...ates to say the same!! If you can't follow the law how can we trust you to make the law?

These were taken on a small section of Battleground Avenue this morning. I can only imagine what the rest of the district looks like. I challenge people to hold "their" people ("their" team) accountable. When Don sees that one of his signs ...has been put up illegally he takes it down (and the only way that can occur is if it is one of the many that we've had to replace that have been "stolen" from private property and put up somewhere else). Candidates need to train their volunteers to do the right thing. To me, it is a question of integrity and it's the law."

There are a  lot of people who just don't care about these rules and regulations . This issue has been going on for a long time with little enforcement but i think there needs to be a NEW RULE . The new rule would be that every sign will have a section of it where the owner of the property will put his address on the sign along with his signature on each sign in the owners property. If there isn't a signature along with the exact address for the sign then the sign is illegal and needs to go. Read the sign regulations and have a great campaign.

2 Guilford County Commissioners Tell Randall Kaplan from Downtown Greensboro Hotel What They Think About Economic Incentive's in Future

During the September 16, 2010  Guilford County Commissioners meeting all the talk was about approving the federal recovery bonds for a new downtown luxury hotel which will be called Wyndham Greensboro. During this agenda item we had our own Triadwatch contributor George Hartzman speak his mind and asked a few questions CLICKHERE thanks FEC at Vie De Malchance.

One of the most unusual aspects of this agenda item was hearing what both Guilford County Commissioners Kirk Perkins and Linda Shaw had to say about something that will probably come back up in front of the county commissioners and probably as well the City of Greensboro which is economic incentive money offered by the local municipalities.

Here is what County Commissioner Kirk Perkins had to say,




As you can see from the video embedded above, the commissioner tells Randall Kaplan from the local group who wants to build the luxury hotel that, "hopefully they won't apply for the economic incentive policy , hopefully if they do we will turn them down but certainly if it is available then they should go for it."
That sounds like a shot below the belt from a county commissioner saying to them don't even think about coming back in front of council to apply for the county economic incentive policy .

But wait there is more because another Guilford County Commissioner in Linda Shaw had something to say as well here is the embedded video below.




The commissioner talks to Randall Kaplan and asks him if he is going to come back in front of us to ask for more money because we are going to stop you right now on incentives. In the video you can see a bewildered look on Randall Kaplan's face in regards to this issue.

It was interesting to see 2 county commissioners come out even before they ask for incentive to let the hotel group know that they can apply for the incentives but might have a hardtime getting approval.

It will also be interesting to see them try to get incentive money out of the Greensboro City Council as well.

One thing that might become a issue is hearing at the commissioner's meeting where Randall Kaplan from the hotel group talked about them being a good tenant for a parking garage in downtown Greensboro but maybe both the Guilford County Commissioners and the Greensboro City Council who will see the economic incentive application can put on a restriction that any incentive money will go towards the building of a parking deck near the hotel and that part of elm street.

Now that this project is on the fast track for completion and needs to start breaking ground soon, it will be fun to see the Wyndham Greensboro owners come back in front of the local municipalities with their incentive package and see if they have the votes for it to pass because these 2 commissioners were trying to say to Randall Kaplan you probably don't have my vote if you come back in front of us.

Spot On Post from Guarino on Greensboro Partnership, and the Missing President

Joe Guarino has a new post titled "The Mystery of the Missing Chamber of Commerce President" CLICKHERE .

In the post Guarino say this:

"If Clapper was a leader with a military background, he presumably had inculcated into him a sense of honor in the context of a merit-based system. The Greensboro Partnership and Action Greensboro, however, consist of unelected elites trying to influence policy in the city of Greensboro and Guilford County according to the playbook of the Democratic Party.



I would argue that represents a culture clash. Clapper's local leaders were busy agitating for more and more public spending and bond issues, and certain local projects to be placed on the taxpayers' dime. In addition, they were crawling in bed with a corrupt PAC."

Strong words that ring true in Greensboro N.C.

Changes to ABC Board in Mecklenburg County , Will Greensboro Do Anything or Play The Delay Game?

According to a new post at blog called Pundit House titled "Big Bucks for Booze Board," Mecklenburg County N.C made a complete overhaul of their local Alcoholic Beverage Control board. At the end of the post this is what was stated:

"Along with the salary adjustments, commissioners also approved other tweaks to ABC oversight and operation: the local board must submit a monthly copy of law enforcement activity report to the board of commissioners; submit an annual balanced budget to the board of commissioners and hold a public hearing before adopting a budget; conduct an annual financial audit and present it to commissioners for review; receive commission approval for any salary increase for the CEO; and obtain advance approval from the county finance director for any ABC Board travel expense that exceeds $1,000."

When will we see our local Greensboro ABC control board take on the issues raised with this report from July 14, 2010 from Mark Binker at News and Record? Here is a link to original report CLICKHERE . Below are some of the allegations,

The report by Alcohol Law Enforcement Officers details several things of value they say Alley inappropriately took from liquor industry representatives. Alley says some of reports findings are wrong and others fell within generally accepted business practices.


Among the reports findings, Alley is alleged to have:


-accepted more than 70 meals from liquor company representatives.
-accepted and/or free lodging from liquor company representatives for travel in New York and California.
-prevailed on liquor industry contacts to obtain free or discounted liquor for personal use.
-collected mini-bottles meant for sale as premiums with regular liquor bottles, giving them to favored employees or taking them for herself.
-reported some bottles of high-end liquor as damaged but keeping them for herself rather than disposing of the liquor in question.
-taken home parts of in-store displays that should have been returned to liquor companies, including bar stools and an electric fireplace.
-ordered employees to forge to the signature of the Greensboro ABC Board chairman on a financial disclosure document


Close to 2 months have passed and not one peep has been heard out of the Greensboro City Council on the allegations against local ABC board general manager Katie Alley.

I want to give out my George Hartzman question for the day to end this post, and it is a question to General Manager Katie Alley.

As you can see from the report, you had accepted well over 70 meals from liquor company representatives, and during this whole process of going out to eat with the representatives, did you ever pick up the tab for one meal during this whole time?

If the answer is yes, please release the receipts.

Katie Alley expected the liquer distributors to pick up the tab. Hopefully, more information will come out on this issue . The local Greensboro ABC board is circling their wagons around Ms. Alley to protect their monopolistic empire of extorted favors, instead of cleaning house, which is what Charlotte and Mecklenburg County did.

Maybe it's time for our local elected leadership to step up to the plate and call for some reforms, even though they recieve the same treatment from campaign contributors with business before our legislature.

Maybe that's why they haven't.

Downtown Hotel: Some words George Hartzman intends to deliver to Guilford County’s Commissioners on September 16, 2010

I would like to begin by questioning the premise
that no taxpayer money will be involved in the proposed Hotel project.

If the Hotel’s financing involves “New Markets Tax Credits,”
that provide directly paid credits against Federal income taxes,
how can this project not involve taxpayer money?

Aren’t federal economic recovery zone bonds and tax credits
subsidized by taxpayers borrowing and accumulating federal debt,
to be paid for by higher taxes on the future income of our nation’s children,
including Greensboro and Guilford County taxpayer’s?

If the Hotel is financed with federal subsidies from the stimulus package,
and receives revenues that would have gone to other hotels and restaurants
that would have paid local, state and federal taxes,
how can anyone say the Hotel project,
which will most likely declare years of tax deductable operating losses,
will not transfer taxable profits from other businesses,
confiscating local tax revenues from Greensboro and Guilford County
by depositing the lost revenues and taxes into a state sponsored business?

If the analysis submitted by the Urban Hotel Group is correct,
could Guilford County’s Commissioners indirectly annually remove
more than $3.6 million in taxable revenues from hotels paying local taxes
to another that will pay far less?

According to the analysis,
if total Greensboro hotel occupancy stays the same city wide,
how could more than $3.2 million in annual taxable revenues
not come directly out of the pockets of privately owned eateries, caterers and bars?

If some who suggest “No Taxpayer Money is Involved,” are incorrect,
what else could be ambiguisly disingenuous?

Are these numbers,
presented by the same company that rejected the feasibility of the hotel
less than a month before, realistic?

Mark Twain said “Sometimes I wonder
whether the world is being run by smart people who are putting us on,
or by imbeciles who really mean it.”

If the possibility exists that this vote is based on inaccurate information,
should the Commissioners investigate the disparities between the two studies
before approving a project that may actually involve taxpayer money,
even though the promoters say otherwise?
