Roy Carroll Local Developer Wants To Amend Parking Deck Agreement with City of Greensboro


Local Developer Roy " North Carolinians for Leadership in Government Political Action Committee" Carroll and his company Park View LLC has brought this item below for the Greensboro City Council meeting next week on May 5, 2009 and will probably see Greensboro City Council member Robbie Perkins have to recuse himself on this issue because his company is the leasing agent on the property known as Center Pointe CLICKHERE. PUBLIC HEARING ITEMS:

19. Resolution authorizing First Amendment to Bellemeade Parking Deck Agreement
with Park View Development, LLC. (roll call vote) (Attachment #19 to Council
members)


Purpose: To amend that parking agreement entered into between the City and Park View Development LLC, dated November 21, 2006. The current agreement allows Park View or its assignee to use up to 170 parking spaces for a term of 30 years. Park View has the right to terminate the agreement after seven years, provided Park View must pay for a minimum of 100 parking spaces in the Bellemeade Deck for a minimum of 84 months.At current parking rates, that would aggregate $420,000 during this seven year period. The requested amendment would allow Park View to pay for a minimum of 50 spaces until the total parking fees aggregated the amnount of $425,000. Park View will retain the right to increase the number of spaces up to 170.



Background: The City authorized an Urban Development Grant Agreement for economic development, on May 16, 2006, with Park View Development for the development of what was then known as the Wachovia Building at 201 North Elm Street. The City's grant to the project was agreed at $1,100,000. This grant is not payable at this time since the project is still in the development stage. On June 20, 2006, City Council authorized the parking agreement to facilitate the grant agreement. The parking agreement, among other things, allowed the City to recoup the cost of the construction of a crosswalk between the "Jefferson Pilot Deck" and the Bellemeade Deck. The cost of the crosswalk was $168,997. The additional $5,000 dollar payment by Park View is to cover the cost of advertising and consideration for the anemded agreement.

Here are a few questions and observations to ponder.

#1 It sure is a coincidence that this item comes in front of council the week Center Pointe from Park View LLC is open for business and getting all the press ,check out this puff piece from News 2 who was there all morning CLICKHERE ,video is on right.


#2 Only paying for a minimum 50 spaces cutting this agreement in half must show the overpriced condos are not selling.


#3 How did the parking agreement facilitate the ecomonic grant for a crosswalk?


#4 What advertising did Parkview LLC get for $5,000 and who approved the advertising on the crosswalk?


#5 This agreement gives Parkview LLC till forever to pay back this agreement of $425,000, there is no timetable for them to pay this off. It takes the 84 months out of the agreement.

#6 According to the Greensboro City web site it cost $75.00 for a reserved space at the bellemeade deck and $50.00 for a general area space. Is the tenants of Center Pointe getting a reserved space or a general area space?



Just a few questions to ponder and am sure there will be more questions in future.

Ryan Shell Love Fest For Greensboro City Council Has Started Minus Roch

Better late than never to the party but today it has been revealed that Ryan Shell has put his name in to the hat as running for a seat on the Greensboro City Council. He will either run for a at-large seat or run in the Disrtict #2 vacated by Greensboro City Council member Goldie Wells.Ryan Shell already has adopted a street and he might just put this mugshot all over town, watch out Greensboro here comes the Ryan Shell yard sign profile and all.

One aspect of his campaign platform on his web site under issues has to deal with the appointment of citizens to boards and commissions in Greensboro. Here is what is on the site:

"Boards & Commissions - While serving on the Greensboro Board of Adjustments I’ve realized that the balance of our various Boards and Commissions is off kilter and that needs to be addressed. For example, the Board of Adjustments should not have two members of the same company sitting on the Board. This can cause progress to be greatly impeded upon should the individuals have a conflict of interest with one of the Board’s cases. Additionally, the methodology in which the council appoints citizens and the information they are provided about the current makeup of Boards and Commissions needs to be re-examined."

Greensboro City Employees Had A Lot To Say About Special Interest Groups in Greensboro

Catering to Special Interest Groups:
◦ Playing politics to gain favor with a particular group.
◦ City council should stop working on pet projects and work on the
core services the city provides. Stop spending money on non-profits
and special interest.
◦ Stop catering to political action groups.
◦ Stop allowing special interest groups to influence decision making.
◦ Stop catering to special interests at the expense of the taxpayers and
employees.
◦ Allowing developers to run the city through city council.
◦ I feel that the CMO should stop catering to the whims of
developers…
◦ Showing favoritism with local developers, people with a lot of
money.
◦ Stop playing favorites with contractors and politicians.
◦ Stop trying to please every special interest group in the city.


As you can see the city employees are none too happy with the City of Greensboro in their total disregard for the citizens and catering to the special interest groups.


If you want a big example of how the Greensboro City Council caters to the special interest group all you need to do is look at how the Greensboro City Council handled the rights of the citizens in their denial of Protest Petitions for over 37 years and back in January they wanted the 2 sides one being the Triad Real Estate and Building Industry Coalition (TREBIC) and the other side which are the citizens of Greensboro along with the Coalition of Concerned Citizens of The Triad, League of Women Voters of the Piedmont Triad and the Greensboro Neighborhood Congress to meet at the last minute on a compromise on state law. To see the city council try to come up with this joke of a compromise on state law was such a obvious bow down to TREBIC and the special interest group. You can also note that this bill should have been passed last year in the short session because it was on their radar screen for over 3 months.The TREBIC special interest group lobbied hard for the council to do nothing and bombarded the state legislators with why the citizens of Greensboro should be denied this state law that every other municipality had the right to use in zoning cases.

Why don't we do another survey on just how many special interest group members are on all of these boards and commissions in Greensboro because last year it was said by Mike Barber at a council meeting in April 2008 that "TREBIC has been contacted and TREBIC has some interest". Just look at what was said by the employees of Greensboro about the special interest groups, need we say more .Barber,Groat,Perkins,Small,Wade,Matheny,Rakestraw,Wells and Johnson
take your TREBIC blinders off and start working for the citizens of Greensboro.

Cyndy Hayworth Will NOT Run Against Zack Matheny for District #3 in Greensboro N.C.



In the bucket of reliable sources but rumor has it that, Cyndy Hayworth will not run against Zack Matheny in the Greensboro City Council race for District #3.

This could have been a real competitive race but since Zack Matheny cast his vote to fire City Manager Mitch Johnson , he took that wedge issue out of the picture come fall, plus the Greensboro City Council also voted for the reinstatement of Protest Petitions for Greensboro which also could have been a real wedge issue come fall if they had delayed the process .

The filing for Greensboro City elections will begin on 7-6-2009 with the last day of 7-17-09 at noon. Let's see if anyone will compete against the well connected , TREBIC campaign funded , who works for a developer ,who needs to come clean on his investment off of Highway 68, who goes by the name of Zack Matheny.

There also needs to be a "DUMP THE DEVELOPER PARTY "as you can see from the picture above come fall on the Greensboro City Council elections.That consist of 2 at large candidates in Robbie Perkins and Sandra Anderson Groat plus district #3 candidate Zack Matheny.It is time the Greensboro City Council started looking out for you as a citizen not the special interest.
It seems like ex-Greensboro City Council member Nancy Vaughan has stepped up to the plate to try to change the direction of council come fall with her announcement of running as an at large candidate. Nancy Vaughan also lives in District #3 as well and since Cyndy Hayworth is not running maybe she might just give Zack Matheny a run for his seat in #3 and not at large, we will see once they file in July.
Who else will also step up to the plate as well?

Greensboro's Paid State Lobbyist Cam Cover Bills For The Last 2 Years

Below is a list of all the bills charged to the City of Greensboro for 2007 and 2008 from Cam Cover who is the paid state lobbyist who works for Brooks Pierce Law Firm. According to the memo from the city, Cam Cover CLICKHERE is paid $135.00 an hour but from my blog post last year it seems that she was paid $125.00 an hour last year. Who approved the new payment of $135.00 an hour because as we have seen the Greensboro City Council didn't even know they had a paid lobbyist.

The city memo also has what the $135.00 an hour paid state lobbyist is doing for the long session for this year. If there is any past history of what she billed to the city and seeing that it was $47,146.20 in 2007, then you are probably going to be close to that amnount for this year in 2009 unless the City of Greensboro can see that this position is a waste of government money and needs to be done away with . Brooks Pierce Law Firm is going to put on a complete cya on why the city needs to have a paid lobbyist . Hopefully citizens of Greensboro can say to the City Council that this is a complete waste of taxpayers money.

If you also want to add another wrinkle to this issue in that Cam Cover is also a paid lobbyist for the North Carolina Cable Telecommunications Association which in reality is the lobbyist for Time Warner Cable. As we have seen in the past few weeks Time Warner wanted to test a new broadband pricing scheme in Greensboro and you have a Mayor who wants more competition in Greensboro and you have a lobbyist who works for Time Warner who will fight to have no competition in the Greensboro area. It will be interesting to see where that might come to play in the future.

North Carolina University System Salary Database , Who Makes What?

The Charlotte Observer has compiled a database of all the university employees in the State of North Carolina and their salary, CLICKHERE or click on the title above.

The database will even go down to each university then you will have to know their last names or which department to put in category. Blue Cross Blue Shield of N.C. and the Near-Bankrupt State Health Plan

With “Sunshine Week” upon us, we’ve been asked to use state and federal campaign finance disclosure laws to shed more light on the ongoing news story about Blue Cross Blue Shield of North Carolina, the near-bankrupt State Health Plan, and legislative oversight of health policy.

An analysis by Democracy North Carolina reveals that no other company the size of Blue Cross has donated more to state politics through its political action committee –- a total of $643,000 from the 2000 election cycle through 2008. Seven company-backed PACs have given more, like those of the big banks and utilities, but all seven of those corporations operate in multiple states and are much larger than Blue Cross. As a not-for-profit corporation, Blue Cross is in a class of its own.

Who are the top recipients of the contributions from the Blue Cross PAC for 2000-2008?

Number One is state Sen. Tony Rand (Democratic Majority Leader and chair of the Senate Select Committee on Employee Hospital and Medical Benefits), who received $36,000. Number Two is Senate President Pro Tem Marc Basnight, who received $35,000. Senate Democrat David Hoyle is next, and several Republicans make it among the top 15 recipients, including former House Speakers Harold Brubaker and Richard Morgan, Rep. Jerry Dockham, and Senators Phil Berger and Tom Apodaca.

Blue Cross has been in the news for the generous payments it receives for administering the health insurance plan for state employees. While the State Health Plan is hemorrhaging, Blue Cross has amassed a reserve fund in excess of $1.2 billion for its three million customers across the state; it rewarded its top six executives with a total of $10.5 million in salaries and bonuses during 2008. The company denies it got a sweetheart deal from special legislation authorizing its no-bid contract for running the State Health Plan, and until recently state Senate leader Tony Rand, who sponsored the special legislation in 2005, has said that disclosure of the contract’s details could weaken Blue Cross’ ability to negotiate competitive reimbursement rates with health-care providers. Sen. Rand is now leading the legislative effort to revise the State Health Plan before it runs out of money.

North Carolina is one of only a few states where the health insurance plan for state employees is supervised by a legislative body rather than by an executive branch agency or independent board. This arrangement puts legislative leaders in the awkward position of monitoring themselves. When substantial political money flows from insurers to legislators, the awkward position becomes more problematic to a skeptical public, even when legislators are doing their best to protect the public interest. On the other hand, the donations from Blue Cross-related donors are a small percent of the millions raised by Rand and Basnight since the 2000 campaign -- and they can only get the money from private sources, including many with competing financial interests in state government, because no public campaign funding option is available in legislative races.
Executives from Blue Cross contributed an additional $117,000 to state politics during the same period of our analysis. Of this amount, $69,000 was donated by chief executive officer Robert J. Greczyn Jr. and $21,933 was donated by chief operating officer J. Bradley Wilson. The top recipients of donations from the executives are Marc Basnight ($20,600), Attorney General Roy Cooper ($18,033), and Gov. Beverly Perdue ($11,000).

Delay Annexation of Millstream To The City of Greensboro New Blog

There is a new blog in the neighborhood who wants the City of Greensboro to delay the annexation of the Millstream area to the City of Greensboro CLICKHERE or click on the title above.

The Greensboro City Council on tuesday voted 5-4 to annex this area in to Greensboro with Small,Wells,and the developer contingent in Matheny,Groat and Perkins all voted to annex this area.

With the absurd rule in the Greensboro charter about passing with only a simple majority then they will have to wait another few weeks till the next meeting for council to vote again. It will be interesting to see if these citizens can sway one vote to overturn the annexation because that would make it 5-4 in denial if all the council makes it to the meeting.

One of the main questions that hasn't been addressed is how come the Sedgefield area of Greensboro are not a part of any annexation at all? It would be great to get any answers as to how they are exempt from any annexation.

Congressional Pig Book Is Here by Citizens Against Government Waste

Keith Brown started a movement that led to reinstatement of protest-petition rights for Greensboro citizens. Now he’s prompted a finding by the N.C. State Board of Elections that Action Greensboro made an improper donation of $5,000 to the George Simkins Memorial PAC for supporting bond proposals.
Brown, who writes the Triad Watch blog, says his research indicates many Guilford County politicians are lax in following campaign-finance reporting rules. He’s probably right, and those politicians warrant closer scrutiny. If they don’t comply with the law when they’re running for office, they won’t when they’re in office.


With the Greensboro City Council local elections coming up in the fall . This will give the politicians ample time to make sure they play by the rules that govern this state in regards to campaign contribution's . Action Greensboro Did Give Illegally to the Simkins Political Action Committee

The North Carolina State Board of Elections has came down with a ruling in the inquiry from Keith Brown to the campaign contribution of $5,000 from Action Greensboro to the George C. Simkins Jr. Memorial Political Action Committee.

Here are a few of the questions that were sent to the North Carolina State Board of Elections.

#1 Is the maximum contribution $4,000 per cycle?

YES

The Simkins PAC and Action Greensboro violated North Carolina General Statute 163-278.13 where the maximum amount that can be given is $4,000 per cycle.

#2 Can a 501(c)3 non profit organization like Action Greensboro give to a PAC?

NO

Action Greensboro was in violation of North Carolina General Statute 163-278.19 because Action Greensboro is registered with the Internal Revenue Service as a 501(c)3 group and therefore is prohibited from making contributions to political action committees registered in the State of North Carolina. The next letter of inquiry should be to the Internal Revenue Service.

What happened to the $5,000 given to the Simkins PAC?

The state board concluded that this money was considered a prohibited receipt and would need to forfeit the contribution to the North Carolina Civil Penalty and Forfeiture Fund.

On March 6, 2009 a check in the amount of $5,000 was given to the North Carolina Civil Penalty and Forfeiture Fund by none other than Melvin "Skip" Alston, the treasurer of the Simkins PAC and also chairman of the Guilford County Board of Commissions and local lawyer R. Steve Bowden name was also on the letter from the state.

As reported in the past on Triadwatch, Skip Alston has his own link CLICKHERE , where you can see from past post that the Simkins PAC might need to hire another treasurer because he doesn't have a clue on campaign law or lately he doesn't have a clue on open meetings law as well.

This campaign contribution from Action Greensboro brings up a whole lot of issues that have been talked about in the past and need to be looked at more closely in the future.

Campaign laws in this state are pretty clear and the total lax reporting of our local Guilford County politicians in regards to campaign contributions need a complete overhaul. The Greensboro municipal elections are coming up in fall and I would like to suggest to all of them to clean up their reports and make sure you are following state law or it will get reported and brought to the attention of our local board or in the case of the Action Greensboro, illegal contribution to the George Simkins Jr. Memorial Political Action Committee it will need to go to the North Carolina State Board of Elections.

Greensboro City Council Member Robbie Perkins Getting Sued by Former Partner in Yes Weekly

Greensboro City Council Member Robbie Perkins is getting sued by Richard Maxwell a former partner. This report will be in this weeks Yes! Weekly by Jordan Green CLICKHERE or click on the title above or get a copy at your local outlet.

While reading the article there was one aspect that really stood out and it all happens to be the transparency in bringing statewide ethics to the local level.
Here is what was said in the article

"Maxwell’s agreement with Perkins and Johnson commits Piedmont Triad Commercial Properties to pay Maxwell listing shares of real estate brokerage commissions paid by Vineyard Ventures, and a number of other real estate companies, including Greensboro Centers LLC, Signature Partners, Century Partnership, 2205 North Elm Street LLC, 612 Industrial LLC and Shamrock Capital Partners LLC. “Maxwell has found himself in a controversy with Perkins and Johnson regarding their other co-ventures, including most pertinently, Vineyard Ventures,” the lawsuit contends, adding that Perkins and Johnson insisted that Maxwell contribute additional funds to Vineyard Ventures. "

Later in the article it was stated about who Robbie Perkins partners are in the venture here is that statement
"Stratton is a Greensboro-based developer, and Johns is described as a partner of Richard Childress on the Childress Vineyards website. "

Look at all of these different business ventures and ties to other local developers and other people.We have already talked about Robbie Perkins and his ties to Roy Carroll another developer who in a few months will get the red carpet treatment from the powers to be in Greensboro on center pointe . It is time for local politicians to inform the local citizens on business relationships that might influence their votes on city council or could get ecomonic incentives for sewer and water.

We need to know who are the investors in Greensboro City Council member Zack Matheny business venture off of Highway 68 or is he still involved with this company?

Who are the other local investors in the companies Robbie Perkins has?
